      ***************** was constructing a new house at ******************************************. During that construction in October 2020 his crew bulldozed through a barrier to gain access to a private road (making it easier to gain access to the back part their property). They brought heavy trucks onto the private road and caused significant damage. No permission was ever asked for nor given to be on my private road. After many phone calls and several non-returned calls, the damage has not been repaired.

      ***************** was constructing a new house at ******************************************. (I am not the contractor for this project.  I assisted with design and the real estate transaction).  During that construction in October 2020 his crew bulldozed through a barrier to gain access to a private road (making it easier to gain access to the back part of their property). (Nobody bulldozed a barrier.  The barrier was already damaged prior to the start of the project.)  They brought heavy trucks onto the private road and caused significant damage. No permission was ever asked for nor given to be on my private road. After many phone calls and several non-returned calls, the damage has not been repaired.  (The lot in question has legal access to the private road.  It is not *********************** road; it serves many homes on the street.  Additionally, ******************** contacted me and I told him I would ask that the ******* be repaired.  I have asked multiple times, as has the general contractor, and am told that it is on the list.  I communicated this to ******************** over the phone.  In this climate it is extremely difficult to get small tasks completed like this done.

      I am rejecting this response because:

      1. The barrier pole was bulldozed over.  ************ was misinformed by someone.  Prior to construction, the barrier was seated about 18 inches down into concrete.  During the construction, the barrier pole was completely removed.
      2. The private road which was damaged is owned by myself.  I maintain the road and pay property taxes on the road.  Four properties are granted access because these properties have no other access available.  Mr. Wards property has other access available and has not been granted access by the owner (myself).  He was misinformed.
            The reason the barrier poles were placed is because his development abutted my property and the city specifically did not give him access.
      3. When I witnessed the trespassing dump trucks damaging my road, I spoke with the ******* of the construction site.  He told me that ***************** was the contractor and that he was responsible for the damage.  I spoke both with ************ and his assistant about the damage and was under the impression that the damage would be repaired.  If ************ is not the contractor, perhaps he could give me the name of the contractor who is legally responsible.
      4. It has been 12 months since the damage occurred.  I believe that is far more than a reasonable time to have a repair done.

      Once again I have said that I would coordinate a repair for ********************.  I have asked multiple people to take care of the item when they can get to it.  I have done this in a "good neighbor" approach.  I am not a responsible party to these issues.  Just someone trying to assist because I know all of the parties involved.

      There are 2 items that he says have been damaged.  One is a crack on the edge of the pavement of the private road.  ******************** contends that the landscaper, Grounds Guys caused that while unloading some rocks.  The other item is a bollard at the end of the street Noble Heights.  This ******* was loose before my client bought the property.  Somehow in the process of building the house it was removed from its hole.  It was not bulldozed.  If it had been there would be a large damage area.  I believe someone probably lifted it out of the hole and then couldn't get it back in.  The bollard is on city property.  I have asked the existing landscape maintenance guy, and a site contractor I know to take care of it because they work in the area frequently and I know them.  Neither had any part in creating the issue, but nobody know who caused this issue.  The first repair I asked a crew from ***** paving to address when they were in the area on another job.  They forgot.  The are scheduled to be back in the area to do a driveway in the next few months and were going to get to the repair then.  The repair is a few shovel fulls of asphalt.  It is not something they are going to make a special trip for.  Contractors in this area are in some cases months behind right now with large jobs waiting.  The minor asphalt repair is the only item that is on property that has any relation to ********************.
