      I entered into a contract for All Aire to install my HVAC products and to supply everything that was needed to complete the installation that was missing. In the contract it was written that would supply and install the flue and ventilation system for our pellet stove. They did the installs in two phases as my wife and I were the builders. After each phase they sent us a bill and we paid them. It was two phases so we paid them twice. First they did the heating system and than the air conditioning. At that time we were a week out before we were ready for the pellet stove and they said let them know and they would get us on their books. We called when we were ready for them. A month went by no calls from All Aire, so we started calling them speaking to the secretary a few times then our calls would not be answered at all. We finally got a hold of the main project manager and he said All Aire can't do it and its ok to have someone else do it. After waiting over two months we decided to do it ourselves. Now on the contract there was around $2500 left on the contract we would owe them for their services. About 8 months latter they show up to our house and our stove was completed and they installed to termination plates for gas appliances and sent us a bill for the remaining amount. I am now in the process of taking them to small claims court for the recovery of expenses of not only our labor, time and delay.

      I am rejecting this response because:

      1. There response is totally false. First off All Air never contacted us about the pellet stove venting. The reality of this situation is that All Air came out to the house in the summer of 2022 to finish the install of the central air condition unit and also correct ventilation ducting . At that point in time I told **** that we were two weeks at the most out to be ready for the Pellet stove flue. His reply was to call which we never had an issue of doing. We welcomed there service because the many items they did wrong he made sure it was corrected. We even told our parents to use them with their HVAC which they did while I was finishing getting the pellet stove ready. Once I was done, We had called.  It was two weeks and the secretary said they would get us on the books and we thought it would be like every other time. About a month went by and we called again because there was no call.  So we called again and the same thing was told to us. We understood that things get missed so we let it go and figured they would make good. As weeks went by we called again and it started to feel like they have caller ID and wouldn't answer their phone. We left messages and finally we were able to speak to ********************* who was the project manager so to say. He apologized and said they had issues with some help and said at that point you can go ahead and get someone else. We are talking three months later and that was the response. It was November when we finally decided to do it ourselves. 

      At that time we figured we were done with All Air because that was the only thing left other than installing two termination plates for our gas lines. In the summer of 2023 we get a call from All Air telling us when they would come and we said OK. We knew they had the termination plates to finish so we welcomed that.A few weeks later we got a bill for $2400 dollars . I sent them a reply that since **** told us to get someone else that they not only broke the contract once but twice by not offering the flue material and what it cost me for the material was well over the supposedly $800 that ********************* said he was allowing for the pellet stove install.

      No, They did not say that they would agree to pay anyone else to install the pellet stove flue but when **** said to go ahead and use someone else they broke the contract and since my cost is way more than what they had budgeted All Air is responsible for our time, cost of materials and permit.
