      in total i have paid this business $633.50 Our contract started May 15th. We were having a driveway gate completed. ******* told me he would be here at 8:30 that morning, i text him inquiring when he was showing up at 10:11 as I had a zoom conference call at 10:30 and he still had not shown up. Then he said he'll be here at noon. he did show up, and left soon after. I text him at 1:19 pm saying I needed to go to the post office. Neither him nor his 2 workers were here. the next two consisted much of showing up and leaving. This is only a gate, not entirely complicated, we never settled on a completion date but on thursday May 18 I text him to ask what is an estimated completion. there was still work that could be completed, staining, fixing the side cutouts that are uneven, cleaning up nails,etc. I sent another $200 on this day and he showed up for about 30 min then left again. I didn't hear back from ******* until I text him on May 22, when I text him asking what the next step is. He then told me he had an accident over the weekend but that he'd be here at 10:30 AM May 22. At 10:15 he text me saying he forgot something and had to go grab it. At 5:28, after he never came back, I let him know he no longer needed to. Our contract was for $833.50, of which i paid $633.50 I want the $200.50 refunded when I paid for service that no longer was happening. The gate is still incomplete. ******* repeatedly showed up late, with no call, no text. I verbally told him one day that even a text would have been the right thing to do. He was always telling me about other jobs he had or was fired from. He never seemed committed to finishing my project and full of excuses. There is more he told me he would do, a bunch of over promises under delivered

      On Friday, May 12,2023 ******************************* of Elite Dock Marine, LLC came to my home to give an estimate for a concrete slab and retaining wall. We were under a strict timeline due to a machine being delivered that needed to go on the concrete pad. We were very clear that we needed the concrete poured at the beginning of the next week. My husband and I decided to hire him for the job, and he required the entire amount of ********* up front. I paid with a credit card on Saturday May 13th. ******************** stated he would be at our home on Monday, May 15th at 7 am to begin the job and have the concrete slab poured on May 16th. At 8 am he still had not shown up, so I texted him asking if he was going to show up to start the job. He texted me back and stated he was not able to get the concrete poured until Friday, and that he was in Janzten Beach at that time. He stated that he would not be starting the job until Tuesday. Knowing that we would not meet the deadline, we told him that we would like a refund and that we would not be using his business for the job. ******************** did not follow through on the timeline he guaranteed at the time of the estimate he gave us for the job. ******************** has texted me that he is going to refund the money, we were scheduled to meet him at his bank to get a cashiers check and he did not show up. He promised to deliver a cashiers check and failed to do that. He then admitted that he had spent the money and does not have it to refund. ******************** has done no work at our home due to being unable to keep the timeline he agreed to. ******************** has no right to keep the $********* he was given. I have multiple text messages where he promises to refund me but has failed to do so. I am filing this complaint to try and get the refund before having to take this matter to court.
