Per hoa we can ask our late fees wavered. I am a senior citizen 1949 birth. Ssi check comes to pay mortgage then pension comes to pay ***************. I can't pay all that by 10th day of month. If they want hoa can do whatever they want as it is all gossip.Business response

Please understand the funds CMI is billing to the owner who has filed a complaint are not CMIs funds, but rather the Association for whom we have a contractual obligation to bill. We are administrative in nature. In addition, the late fee policy is not CMIs, but rather the Associations approved Collections Resolution which we are obligated to follow. Under no circumstances should this be a BBB complaint against CMI as the late fee is not implemented by CMI, but rather dictated by their clients Resolution.
The owners monthly fees have posted after the 10th of each month for the last 15 months in a row (in some cases as late as ***** days), and in 4 cases her payments have been returned for insufficient funds causing even more delay in posting her payments.
The Westlake ************************** generally allows one late fee write-off per calendar year for owners in good standing. The Collections Resolution in place states monthly fees are due on the first day of every month, with late fees applied if a payment hasnt been posted to her account by the 10th of each month. The checks are mailed to the Associations lockbox.
The Association has written off late fees from this account twice in the past 15 months, and has suggested to the owner she try to get a month ahead so she will not be accruing late fees each month, although the Board is aware it is not always feasible.
The ****************** of Directors have expressed their willingness to consider writing off some of the previous additional late fees late fee should the owner show good faith and pay the assessments on time for 6 months. They are reluctant to write off additional late fees at this time as they are concerned she will continue to make payments late, as well as ask for the late fees to be written off each month going forward.
The Board is sympathetic to her financial situation, but believe it sets a bad precedent to allow one owner to pay late every month without penalty when the other owners are expected to pay on time.
