My Wife and I (Sellers) entered into a Sales Agreement with Buyers on Oct. 16, 2023. The Sales agreement contained 3 tax lots in *******, Oregon. The real estate transaction (closing) was handled by Ticor Title. Ticor Title Deeded 2 additional tax lots, not contained in the Sales Agreement, to the Buyers. Ticor was informed about the mistake within one (1) week. Both my Agent and I have called and emailed repeatedly. Ticor Title will not respond.Customer response

I am rejecting this response because: Attached is the transaction summary (dated 9-8-23) from Oregon First Realty of the real estate agreement with the Buyers. It clearly only has three (3) tax lots. Upon checking (1-11-24) Multnomah County Property Records, R339727 (TL500) is still owned by the ****** Trust (My Wife and I have a living trust).

I am rejecting this response because: I received the same response on **** as I received on 1-11. Sending the same response is not acceptable. This has been an issue since mid September 2023.. Now it appears that the issue is being passed to another person. I do not want to hire an attorney but if needed, does my Title Insurance cover the attorney fee(s)?

I am rejecting this response because: This response does nothing to resolve this issue. In effect the company has shifted the burden to the Sellers and Buyers of this transaction. The burden should fall directly on Ticor Title. Now its almost a "Hostage Situation". Unless the Buyers and Seller go to the ********************** and ask for help, Ticor will not aid in re-recording. Maybe ask how did this get past Escrow? Should this have been brought up prior to recording?. Attorney for Ticor *************************** states that "************************************** and ********************************* (the Borrowers) received "more land than what was intended by the parties to the transaction". This is the nature of my claim (complainant) and verifies that claim.
The re-recording should happen immediately as the 2 properties in question were not in the sales contract. Then and only then we can figure out the next steps -.description/partition., I am asking Ticor to do the right thing and they keep shifting blame, and shifting burden.
