We hired **** (owner m) of Wapiti structures to build us a house. We agreed on a down payment of $9,000 to start the process. This would include plans, permits, engineering, administrative time. After several months of little to no contact we took over speaking directly to the plan drawer and began that process ourselves. We would contact **** and get no reply or a false timeline that he would not meet. After a year of dealing with **** we decided to move on with a different builder. I called **** told him we want to stop this process and would like a return of our funds. **** agreed and said he would be in contact. Its been nearly 6 months since we fired him and havent got any money back, nor will **************** our phone calls or texts.Initial Complaint

I paid Wapiti Pacific Contractors for two jobs, with separate contracts signed Feb 24, 2023. The first to grade/rock/prepare a barn pad ($13,446). The second to fabricate a 36x36 barn ($44,927). As required by the contract, I paid a deposit of $6,723 for the excavation and a barn deposit of $11,231 via personal check. Only **** from Wapiti started work on 4/13/23 and for several hours on 4/14 and just a couple hours on 4/15/23 due to some wet weather. When we last spoke, we were on good terms.On 4/21 he said he was grabbing his equipment and would return the following week. Equipment was removed on 4/24 when weather improved and contrary to when **** said he would be resuming.On 4/26 I received a somewhat threatening email stating that I was not being cooperative. This was confusing because there was no known contention or issues with our prior conversations.I recognized some miscommunication and pleaded with him to call me or come talk to me to clear things up with multiple attempts to talk with him- no response.On May 1 **** emailed he was issuing a "disengagement letter". There was no official reason for stopping work except he wanted me "to have the experience along the project." I kindly pleaded with him to continue work, explained to him I was NOT wanting him to stop and that my best interest and desired experience was to keep working and call me to discuss what the issue was. I emailed a sincere apology on 5/2 about any potential miscommunication and desire to reconcile. Explained I don't understand what I might have done wrong but never received a response and won't answer calls.I need him to finish the project or refund 100% of money paid. ******** agreed that his "vision" was critical to complete the excavation design. Since it's based on his vision, it's impossible to transfer to another contractor. I received a quote 5/3/23 to complete the excavation of $13,320.62- nearly the same as the original contract I hired **** to do ($13,446).
