On July 23rd, 2021, a design agreement was entered with BLACK CHERRY DESIGN (BCD). BCD agrees to provide the services of design, project management, and manage purchasing and delivery of FF&E (furniture, fixtures and equipment) to site. Detail in attached agreement. Payments Paid to BCD:By January 2022, Design fee paid $11,100 By May 2023, Purchase Order paid $82,463.52. Among $82,463.52 for items:o$22,287.73: items installed and function. o$60,175.79: items either NOT delivered, either NOT installed, or NOT functioned.Till today, the project remain un-finished, Kitchen, Living Room, Main Restroom, etc., are in status of construction field, cannot function normally and acknowledged defects in most areas, most paid FF&E NOT delivery, paid & installed countertop, the countertop supplier is chasing us for BCDs payment to them, etc. Detail in attachment file <<3--Payment Invoices with status of Items paid.png>>.When the contract period and the delivery of purchased materials were seriously delayed, we communicated and urged BCD many times. BCD made many promises to complete the plan but never completed it. Since March 2024, BCD has NOT made any progress on the project matters, has not responded to project communications, no company personnel has come forward to solve the problem, and the door keys requested to be returned have not been returned.Requirement BCD to follow agreement to accomplish this project by May end, and:Immediately respond with the project completion plan and execution the plan.Immediately deliver all paid but undelivered or unqualified items. Timely settlement of purchases that have been charged but not settled according to the order with the ************** Construction supplier JBK was selected following BCD's recommendation.
