    I am contacting you demanding payment of $5,512.50 (Invoice#*****). I am attempting to resolve this 
    out of court, but if we cannot come to an agreement, I intend to sue. 
    Here is a statement of my case that I intend to submit to the court:


    Following several verbal discussions on August 29, 2023, at 12:58pm, August 31, 2023, at 
    1:27pm and 5:38pm and I entered a contract with Dominic J**** of Euphoric Essentials on 
    August 31, 2023. Under the contract documented via text message, a representative from 
    Euphoric Essentials was to have a dumpster delivered on Saturday September 3, 2023, and 
    demolition of a mobile home and shed located at ** ****** ***** *********** ** ****** 
    however, no one showed up. I contacted Mr. J**** of Euphoric Essentials via text on Tuesday 
    September 5, 2023, at 12:23pm requesting an update. I received a response on September 5, 
    2023, at 12:26pm stating the dumpster would now be delivered on September 12, 2023, due to 
    the holiday. At 12:29pm I requested confirmation that the dumpster would be delivered, and 
    the work would begin on September 12, 2023. Euphoric Essentials responded “Yes”. 


    Unfortunately, no one showed up on September 12, 2023. 


    I contacted Mr. J**** of Euphoric Essentials via text at 3:35pm requesting an update with no 
    response. Beginning at 7pm on September 12, 2023, I attempted several phone calls with no 
    answer from my personal phone. At 7:30pm I called from another phone and engaged in a 
    verbal discussion with Mr. J****. He stated he had a “custody issue” with his children and was 
    unable to speak. I requested that he contact me on September 13, 2023, with an update and 
    plan to complete the work; however, I was never contacted. At 12:35pm I sent a text requesting 
    a callback with no response. I also attempted to call from two different phone numbers with no 
    response. At 4:44pm I sent a text stating if I did not receive a response or call by 10am on 
    September 14, 2023, I would move forward with another contractor and move forward with 
    legal proceedings to seek a refund due to breach of contract. 


    On Thursday September 14, 2023, at 6:23am, I received a text from Mr. J**** stating he went 
    past the property on September 13, 2023 “to make cuts and measurements and planned to be 
    on the property September 14th and 15th to clean out the mobile home. I responded at 8:08am 
    to confirm I received the message and requested pictures at the end of each day to demonstrate 
    progress. On September 14th at 3:10pm I received two videos showing contents in the mobile 
    home: however, I was unable to determine if they were before or after work had been done. 


    During the evening of September 14th beginning at 5:54pm, several verbal and written 
    communications occurred between me and Mr. J****. Mr. J**** stated work had been done at 
    the property; however, he had no proof of the progress, despite my multiple requests for 
    pictures. In addition, he stated he needed additional money to complete the job as he had used 
    the original $3,675 to pay his workers. I requested documentation of payments made for work 
    at 33 Berger Road, but he stated he couldn’t provide anything as that was not part of his 
    standard practice and he paid them in cash. He subsequently asked for the $3,675 balance to be 
    remitted to complete the work. At the end of the evening, I agreed to pay an additional 
    $1,837.50. Per my request, Mr. J**** provided written confirmation via text that “no additional 
    payment will be issued until after the job is completed and the original quote would not change. 
    In addition, he confirmed he would be on site September 15th, 16th, and 17th, 2023 and would 
    send daily photos to show progress”. Lastly, Mr. J**** provided written agreement via text that 
    the job would be completed on or before September 25, 2023. 


    On September 15th, 2023, I texted Mr. J**** for an update at 5:20pm. At 6:12pm he sent six (6) 
    pictures and a text description of the progress from the day. On Saturday September 16, 2023, 
    at 5:11pm, I texted Mr. J**** as he had not provided an update as agreed, I received no 
    response. On Sunday September 17, 2023, at 9:05am I texted Mr. J**** again with no response. 
    As a follow-up, I made two attempts to call him one from my personal phone at 10:24am (no 
    response), and one from another number at 1:02pm. Mr. J**** answered the 1:02pm call but 
    immediately hung up when I said hello. I attempted to call back immediately, and the call was 
    sent to voicemail. At 1:06pm I sent a text to document that I just called, and he hung up on me. 
    In this communication, I reiterated my intent to proceed with legal action.


    On September 18th, 2023, I again attempted to call Mr. J**** once from another number at 
    4:15pm and once from my personal phone at 4:39pm with no response. I sent a follow-up email 
    at 4:41pm stating due to his lack of response, I assume he has no intent to complete the work at 
    ** ****** ***** *********** ** *****. 


    I look forward to resolving this matter amicably. You may contact me at *********@*******.net if you

    listed above. 


    If I do not hear from you by September 25, 2023, you leave me no alternative but to file a lawsuit 
    against you. In the event of a lawsuit. I intend to seek redress to the fullest extent permitted by law 
    including, but not limited to, additional damages, legal service costs, court costs, and accrued interest.
