      Storefront owner *************************** of nDesign Art Haus, LLC, *******************************., Carlisle, PA has not properly completed the website job she promised and for which I’ve paid. Unfortunately, I paid up front for services and was continually pushed through meetings with my spouse as she, Natalie gave excuses as to why she couldn’t allow much time for any meeting to review the entirety of the website, pushing me to write a pos review and signing a contract before services have been properly rendered. Namely, two services she did not complete are making each image on the site expandable for close-up viewing and coming through with business cards costing 93.00. Now she is trying to push the former part of the job onto to a coworker within her company and he is asking for money and she has said she is only refunding 38.00 of the 93.00 business card charge. She said that she would send a j.peg image of the card for us to print at *******!

      My response to the case: ******** (***********************) is as follows:

      June 15th, 2022 *********************** made a request that the images do not “expand” after not explaining at any time that this was a request that she would like to have on her website.  Clients are required to fill out a website questionnaire to help us understand how we can best help and meet the customer's needs and nowhere in her initial inquiry was this ever mentioned.

      I, **************************** made changes on June 16th, 2022 so that the images did “expand” and **. ******** in person on November 20th, 2022 asked me to change this back to the "original" outline of gallery boxes, to which we did.

      After the fulfillment of our obligations for **. ******** site, ****************** then contacted the contracted web designer, ******************************* on December 14th, 2022 on his personal ******** messenger to "make a pinch and pull effect" to which ******************** did and ****************** expressed to ******* that "It is different but not what I want."  She then proceeded to state that She should pay for it referring to myself, **************************** not understanding that nDesign Art Haus and its contractors are service based providers and we work on an hourly/contract rate to which ****************** had been well over the 8 hours/ 15 pages allotted. I have sent several text messages and emails reminding ****************** that our design rate allots for 8 hours of total design time AND/OR 15 webpages and any time spent on our design rate is $65 per hour.  ****************** had told myself, **************************** after explaining this to her, that she understood and understood what was outlined in her initial invoice.

      An outline of a proposal is sent to all web and graphic clients as is per policy.

      Please see attached image of timing spent on **. ******** site:  We offer 8 hours OR 15 pages and **. ******** site went well over the 8 hour threshold exceeding 60 hours.

      We, ******************************* and myself, spent a considerable amount of time on **. ******** website to which she kept changing her mind after saying that the changes were great.  ****************** and ********************** also did not remember setting up a M365 account for her email and continued to text and email me asking when the email would be set up insinuating that I, *************************** and ******************************* were not working on her site to which I then had to contact ******* directly and set up a conference call with ******************.  It was then discovered that **. ******** wife, ******************************* set up a **** account and forgot.

      ****************** paid for the business cards in person, using the ********* portal on 9/13/2022 at the final meeting of her website to which she said the site looks great and no changes need to be made.  I was with ****************** for close to 1 hour 30 minutes going through any changes that ****************** might like on her site. ****************** also took a considerable amount of time to get back to me about what she would like placed on the business cards which delayed the files being sent to production.  I sent various reminders to her about what she would like placed on the back of the cards.

       ****************** and her wife, ******************************* had emailed me repeatedly asking when the cards were ready to which I continued to prompt ****************** to please verify WHAT information she would like on the back of the cards and if the cards were approved by her to order.

      The last time that ****************** and her wife, *********************************** came into the gallery space, I had offered to refund her for the cards to which ****************** said No, I would like them and if they did not arrive in satisfactory time then they would like a refund which I offered.

      Please see attached images of the order stating it was delayed.

      I canceled the order on 12/9/2022 after placing the order on 11/25/2022 to which the original order had stated they would be delivered by 12/7/2022 but there was a delay in printing. ****************** took considerable time in responding to my request as to what she would like placed on the back of the card and her wife, ************************************ stated that if they were not here soon then they would just go to Staples.  I offered a refund in the amount of $38.00 when ****************** and her wife, ******************************** came into the gallery and asked where the cards were and I explained there was a delay in the production.

      See attached image of the invoice for the amount charged for the product and also the service design of $50.00

      ******************* owns the digital file and was charged $50 for the business card design rate and $40 for the product.  I will not refund the design rate as she owns the digital file and is able to take that file and get them produced elsewhere.  I am offering to refund her for the $40 minus the transaction fee which I had sent to ***************** originally on 9/13/2022.  I had stated to ****************** and *********************************** that if they were not here in a satisfactory time then since they owned the file, they were free to take the cards elsewhere to get printed as they own the file.  I had not sent the refund to their residence at:

      Because she opened a dispute with *********, freezing any funds that come through the portal on 12/11/2023.

      I can not send any funds to ****************** until the dispute is resolved as it was relayed to me that they are waiting for a response from **. ******** bank.

      I did dispute the initial dispute with the same information that I have sent to you and the ************************** that ****************** is not liable for a full refund but a partial refund since we DID design the cards but the delay was in the printing.

      ****************** made several comments pertaining to my race and my sexuality and accused me of being a bigot and compared being *** to being a mixed-race ****** woman both in person and over the phone and through text messages.  ****************** also continued to ask me to come over and party with her and her wife ****** and mentioned that they like to smoke weed and party to which I said, Im not interested.  [See attached image]  They also came into the gallery several times inebriated and intoxicated while I was trying to work on the website with them.

      A compilation of these comments led me to feel as though I was being harassed and several lines were being crossed beyond that of a web designer and made me feel as though there was an underlying sexual component to our meeting to which when I spoke to ****************** and explained that I will no longer be working on her site or items because of the comments made from here forward.  

      ****************** also had several emotional outbursts with her wife while I was working on the website in their presence and I saw a display of physical outbursts while they were in my gallery and I explained to them both that I will not be able to provide any more services or contact if they continued to present hostility while I was working on services for them to which ****************** stated that she understood. 

      We have fulfilled and finalized **. ******** website at: ************************** as of June 16th and have no ramifications to continue to make any changes to her site or monitor any social media accounts or provide her with any more consultation regarding her site and/or artwork.  We have gone above and beyond for our obligations in our roles of customer service. 

      A refund was offered in the amount of $38.00 for the product stock that was on delay for **. ******** business cards but NOT for the service charge of $50 for the design of the cards.
