      Contract dated 12-2-2022 with iPave, LLC to grade my driveway and provide commercial grade blacktop (asphalt) 3.5" thick for $7,000, including a one year warranty. My driveway has been crumbling since it was installed and has developed some holes where asphalt is less than a 1/4" thick. *********************** from iPave, LLC is the contract signer for iPave and he was onsite when the work began on 12-5-2022 along with ****** and his crew from ************************. My husband and I have had new asphalt driveways installed in 3 different homes and we have never experienced this type of crumbling and holes and began sending emails to both companies on 5-27-23 requesting repairs.5-27-23 first email 6-5-23 second email to iPave after no response to first one 6-6-23 email received from ***** at iPave requesting photos and said would send someone in 2-3 weeks when they were doing work in my area.6-6-23 I sent pictures 7-11-23 I sent another email after not hearing from iPave 7-18-23 I sent another email after still no response iPav 7-26-23 No response yet

      In July 2022, I entered into a contract with IPave LLC out of Chambersburg, Pa to install a new asphalt driveway. The total cost for the new drive way was $17,000.00 The contract specifically stated 3" of compacted asphalt and 4" of stone base. Also this contract comes with a 2 year warranty. Below are the following issues that have occurred since July of 2022:-Sides of my driveway were not tampered -Areas of cracking -Standing water in driveway -Uneven spots in driveway -Thickest piece of asphalt I could find is just over 1 -Several areas where there was either no stone base or less than the required amount as stated in the contract. I have recently received 3 bids ( Driveway by ****, ****************, ***********************) from asphalt companies to repair and meet the conditions of my original contract. All bids came in over $20,000.00 to repair and provide minimum 3" base.I have attempted to reach via email and phone to IPave with no response. I have attached the contract and pictures to demonstrate the poor quality of work.

      Wed like to start with the fact that ******************** contacted us for the first time on March 13, 2023 requesting a copy of his contract. Once received he then proceeded to email us regarding this matter, for the first time. Our office isn't technically open full time until April 3, 2023. The email with complaint was sent after winter business hours. He was told yesterday (less than 7 business days after his initial email) that we were not in the office full time, however, we had pulled his paperwork, and informed him we would have someone come out to review the issues. He was also informed the asphalt plant in the area is not even operating at this time. ******************** has a 2 year warranty on his driveway, and we standby that warranty, however, we are unable to jump at his request as we are a business with jobs and customers scheduled before this complaint was even reported and before the paving season has even started.

      We do not believe that we were given the chance to even address the situation, before going to the extremes of contacting not only your office but three other asphalt companies, one of which is not even a paving company, just a sealing company.

      We stand by what ******************* was previously told, as someone will come out to review the issues and we will stand by his warranty, however this will be done on our time, as we run a business. I've yet to find a business that operates on my time and not their own.

      I am rejecting this response because:  I have made an attempt via phone with no response.  I sent a email which today exactly 7 days for the company to respond with justification that they are waiting for the asphalt plant to open.  I submitted another email requesting an appointment with no follow up as of today.  Using the Asphalt plant as justification to not at least come out and see this issues is absolutely unacceptable.  

      I have paid $17,000 for a driveway that is literally falling apart and all I am asking is for someone from the company to come out and survey my driveway and develop a plan to fix my issues.  

      Receiving the silent treatment is very unprofessional.

      I still have yet to receive a phone or email for IPAVE to resolve my driveway issue.  I attempted to reach out to them via email once again but still have not received a response.  It is very clear on IPAVE part that they have no intention on contacting me.  I am at the point to where I may have to retain legal counsel in order to get resolution.

      There have been multiple attempts to reach ******************* via phone calls by the owner himself, with no answer. As we stated before, the driveway is under warranty and we will fix the issues. Weve contacted him, you the BBB, and the general attorneys office reassuring the driveway will be assessed and addressed accordingly. This is not an issue that can be rushed, as the weather has been horrible, the asphalt plant has been down MULTIPLE times already this year, and we are running a business, therefore we have contracts already signed and scheduled that we are behind on and must be taken care of as well. ******************* has not called the business phone. The emails sent to a personal email were acknowledged and responded with the same response of it will be assessed and addressed accordingly. ******************* demands things done, calls made, and deadlines met on his time, however once again we have tried to contact him via phone calls. We have not forgotten nor ignored *******************. We have letters from BBB, Attorney General, and now a lawyer and nothing has changed except not being able to get ahold of ********************

      I am rejecting this response because:  As of today I have still yet to receive a phone call or email from IPAVE.  Even though they have stated there attempts to call me.  I have received my phone records and no number from IPAVE or the owners cell populate.  I have retained a attorney and provide a 30 day demand letter to IPACE in order to resolve these issues.

      On Wednesday May 24, 2023 at 4:20pm, ********************** (owner of iPave LLC) arrived at *****************, property of ***************************************. ************* was accompanied by ******************* and  reviewed the areas of concern. There is a well calculated process of new construction, creating a base, and laying of asphalt. All thickness of asphalt is an approximate/average number prior to proper compaction, which ensures a level finish with proper water flow. 


      Upon review, ******************* was advised that the damages caused to driveway were in conjunction with a new construction of detached garage, and vehicles/machinery on the new driveway as well as driving over the edge of the driveway, which led to breakdown of structure. ******************* was advised there was no need for the driveway to be completely re-paved, nor would we do so. With that being said, ************* advised ******************** that even though the damages were not due to poor quality of work nor the product, we would fix the issues, without guarantee/warranty, as areas such as edge to detached garage and the continuous motion of traffic over edge will continue to break down the structure. It was understood that there were estimates from other competitor companies, however, their goal is to make money, not just fix the issues from another company. 

      Please acknowledge, while advising ******************* of options, ************* noticed he was being recorded via cell phone, without consent. 

      Even though the issues were not due to quality of work by iPave LLC, nor the product itself, we attempted to resolve/fix the issues presented, only to be denied by ********************

      Given the outlined information provided above, we feel there is nothing additional we can do for *********************
