      To Mortgage Connect: Please escalate this to the level of management required for authorization and/or response, which I am expecting to be within the next 24 hours. On June 14, 2024 I completed all the documents necessary to complete my assumption and to close. I was also advised that the seller (**** *******) had completed the necessary documents. Of note, are the attached notices from mortgage connect with the Wrong email addresses and names. On July 5th I received a notice with the wrong name/wrong address. I assumed this was an error, I then notified mortgage connect with no response. On last Friday, July 12th I received a call from a representative of mortgage connect to complete "my" closing only to find out this person called me in error as she was trying to reach **** *******, the seller. It was then that I was advised of the an issue. I then contacted mortgage connect to clarify what the problem was. Mortgage connect did not communicate with me the Buyer as to any issues nor is there a response from Mortage Connect as to the current status. And yet —this is MY home and MY mortgage. Of note, the Seller made arrangements to sign, not once, not twice, but THREE TIMES as there were two NO shows. Please see the email chain below. You can also see that I am asking for clarification as to whom is expected to sign—I received No response. Thankfully, I have had the privilege of working with Freedom Mortgage to address and complete the documents to rectify this error. However, I now have to go through the closing process AGAIN. My credit report will be run AGAIN. My closing was a MONTH ago. I expect, at the very least, a written response and apology along with a full refund of any payment i made for this disgraceful service. This is an egregious wrong that needs to be made right, with immediacy.

      Jackie W******* called me on 7/17 at 5:25p. It is currently 7/23 at 11 am and I have no clear status or updates as to this matter. This is completely unprofessional and deeply concerning. I have not been provided with a clear status of my assumption and the next steps in this matter from Mortgage Connect. I have attached here the most recent communications with Susan B*****, which is inconsistent and, again, there is an error with the name of the seller and there appears to be confusion as to whom she is communicating with and why. This is just beyond a mere complaint this is a complete nightmare and egregious business practice.

      I am also receiving non-stop calls of solicitation as a result of this error. I have attached a sample of the calls i have received:

      since 8:28 am until 11:20 am today I have received over 26 calls

      yesterday 7/22 I received 56 calls and 2 texts messages 

      Friday 7/19 over 43 calls 

      I was told in my conversation with Ms. W******* that she would assist in this matter. I have not heard back from her since 7/17. I would appreciate a clear response as to the status and next steps. I would also like to know what is being done at Mortgage Connect to rectify the matter. The conversation on 7/17 with Ms. W******* she claimed to help with correcting the damage to my credit rating as well as the refund for closing costs.

      I would like this confirmed in writing as well as to any additional measures as a result of the harassing solicitation calls I continue to receive.

      On January 31, 2024, I received a envelope from “Mortgage Connect”, which contained a document titled “ correction instrument upon original recorded instrument”, there was no explaining what this document was, there was receipt that the document had been filed online via the county clerks office. Upon further investigation, it was clear that “Mortgage Connect” use my personal private information to complete and fraudulent refinance of my home. “Mortgage Connect” is not licensed under is true EIN to complete title work within the state of Texas. It seems very clear that “Mortgage Connect” solely works with debt collection companies, helping these debt collection companies take interest from certified owners of their properties to give the interest to these debt collectors. There has been an insurance fraud claim filed against “Mortgage Connect” for doing title work on Texas properties without having an insurance title license within the state of Texas.

      Thank you for the opportunity to respond to the active complaint referenced above. We are a title company with offices in several states, including Texas. Our main office is in Pennsylvania, Mortgage Connect LP. Our Texas office is Mortgage Connect of Texas LLC, wholly owned by Mortgage Connect LP.  Mortgage Connect of Texas, LLC is a licensed Texas title company. 

      We have clients, specifically lenders who request our title services. On this specific transaction, our default title team was requested by a lender to perform a title search on this property. A title search is performed on the public land records and does not involve or require a borrowers non-public personal information (“NPI”).   Our title search revealed that there was a discrepancy in the legal description, specifically the remaining subdivision plat reference was omitted on the original deed of trust. 

      Our lender client requested that we cure the non-material discrepancy in the legal description of the original Deed of Trust dated January 9, 2021 between ***** ******* and Cardinal Financial (Freedom is the successor/assigned from Cardinal Financial). The “Correction Instrument as to a recorded Original Instrument” of Non-Material correction pursuant to Texas Property Code 5.028 was filed of record to correct the legal description on January 25, 2024. The correction merely added the remaining plat reference for the subdivision recorded to the legal description that was omitted on the original recorded Deed of Trust. The filing of the Correction Instrument does not create any lien on the property nor does it change the underlying terms of the Deed of Trust.  It simply acts as an approved method to correct minor discrepancies in the public land records. 

      Upon recording of the correction affidavit it is required to send a copy to all parties to inform them of the correction.  We sent a copy to Ms. *******. 

      Mortgage Connect is not a lender. At no time did Mortgage Connect have access to any of the complaintants NPI, nor did Mortgage Connect refinance or cause to refinance complaintants property.

      I ***** ******* affirm & swear that I have personal knowledge that “Mortgage  Connect” removed Harris County Clek’s general’s file number (GF number) and placed it’s Business affiliates (Freedom Mortgage) account number and was paid to do so.

      I ***** ******* affirm & swear that I have personal knowledge the definition of identity theft is to use one’s personal private information for material gains, and said person did not consent to the use of their personal private information. “Mortgage Connect” has committed identity theft against me and is conspiring to sell my property with a debt collector that has no debt liability in my property. 

       

      I have attached evidence that “Mortgage Connect, indeed, about a fraudulent lien against my property, in which the Districk clerk of Texas have countered the fraudulent lien. 

      “Mortgage Connect” except the liability of 75,000 per day until the fraudulent lien is removed against my property, and or 1.5 million per day if I have to bring further countersuit against “Mortgage Connect” it’s business affiliates including “Freedom Mortgage”, “Cardinal Financial”, it's Assignors, successors, heirs, stockholders, shareholder, employees, and legal counsel.

      acquiesces does apply if “Mortgage Connect” do not provide A contract between myself “Freedom Mortgage”, as well as Mortgage Connect, proving that I consent to any transactions with both companies to explain the actions that “Mortgage Connect” committed against the certified owner ***** ******* as well as to ensure that “ “Mortgage Connect” practice due diligence as a licensed and bonded title company within the state of Texas under the regulation of Texas.

      Through Mortgage Connect, I am listed on their closing documents as a borrower although I have not given them permission to add me as a borrower. I am in the middle of a separation and divorce and my husband has to buy me out of our house. I went to sign a "Clear to Close" document and was presented with all of the closing documents which I was told I had to sign as a borrower. I spoke with Rob W********* and he said they were trying to have the documents revised. He gave me the name of the person in charge of that. His name is Michael *. M****** refused to give me information about the closing documents because I am not listed as a borrower. I am listed on 3 documents as a borrower. This seems to be fraudulent on behalf of Mortgage Connect.

      Ms. P**** contacted me one time on Friday, 4/21/2023 and left a message.  I have been out of town for a wedding and just started going through my messages. The company has wasted my time, energy, and money in legal fees and sent me a $50 Visa gift card and a 4 sentence apology.  A $50 gift card does not put a dent in the legal fees I have had to pay to remedy their fraudulent paperwork and lack of ethics and professionalism.  I have called Ms. P**** (4/25/23 at 12:00PM) and left her a voicemail.  I will follow up with an email again. 

      I sent the following email on 4/14/2023 to the following emails *************************** ******************************** ********************************* ***************************** ****************************** **************************** ****************************** ***************************** ***************************** ******************************* ****************************:

      "Ms. P**** and Mortgage Connect team:

      I received a 4 sentence letter from Ms. Y**** and a gift card for $50. This comes no where close to the amount of time and money I have had to spend to correct your company's documents with me listed as a borrower without my consent. In fact, I consider this to be an insult considering what I had to pay in 2 lawyers fees and the time and energy I invested trying to effectively remedy this issue.

      Please see the following document where I am listed as the borrower.  I have already provided this but...here it is again...I am listed as a borrower on 3 documents and need to be removed (see pages of the "Unsigned Closing Packet" attached, pages 32, 95, and 101).  I am also being asked to sign the "Deed of Trust (page 59).  He is also listed as "unmarried (pg. 41).  This company needs to be held accountable for my lawyers fees, as I was threatened with litigation and had to have a real estate lawyer review the paper work and advise me with the information I already provided Mortgage Connect. Please see below:

      A separated person selling or refinancing property – Unless severed by a properly drafted agreement, marital rights exist until a court enters an order for absolute divorce.  Simply being “separated” from a spouse does not, by itself, terminate marital rights.  The owner needs to sign documents to convey title, and the owner’s spouse needs to either (1) sign to convey marital rights, or (2) sign a properly drafted and recorded document to sever marital rights, commonly known as a Free Trader Agreement (see below).

      You have been provided a legally drafted separation agreement.  If not, it is attached. Please see "7 Marital Residence."
      A “Free Trader” owning property individually – In general terms, a Free Trader is a married person whose spouse has already waived or severed marital rights.  This can be accomplished by a prenuptial agreement, postnuptial agreement, separation agreement, or a Deed between the parties reciting statutory language necessary to waive marital rights.  The instrument that severs marital rights should be recorded in the Office of the Register of Deeds in the county where the real estate is situated.  Provided spousal rights were properly addressed, a Free Trader can conduct real property transactions without involving their spouse.

       

      Furthermore, I would like Ms. P****'s supervisor to contact me.  She was unprofessional and wasted my time reading me the information I sent, cut me off, and had nothing of consequence to offer me besides her 4 sentence apology (I see this as accepting fault in the matter) and a $50 gift card which, as I told the company, is an insult based on what I had to pay for legal guidance.

      To reiterate, the problem is that I had to deal with your company's mistake, as a listed borrower, before being removed from the fraudulent closing documents.  Those have been provided as well as legal documents that my lawyer had to prepare.  I received the message below after refusing a $500 settlement from Shaun P***** on 5/12.  His response was sent after whoever responded to this complaint with BBB on 5/16.  His email came on 5/17.  Your response saying you can no longer communicate with me is thus inaccurate.  This is just showing more of the unprofessionalism of your company and its ineptitude in working together.  I highly suggest, as a professional myself, you get in contact with people within your company.  I would also suggest your company hire or invest in professional development related to human resources, customer service, and mortgage fraud.

      I closed on my home puchase at *** ******** ** ***** *********** ******* *****, on November 18, 2022. Firstly, the notary they hired was extremely slow and did not get the funds to the seller in time for the weekend move. Fast forward a month or two and they hadn't mailed out my home insurance check. I have repeatedly emailed them about this just to be ghosted/ignored, and now my Travelers Home Insurance says they will cancel my home insurance policy on March 6, 2023 if they don't receive payment. Almost 4 months after closing!

      Mortgage Connect was hired by my bank (Wells Fargo) to handle processing of our deed and title when we did a refinance on our home last summer. We believed everything had been handled as we signed all the requested paperwork at our closing. In April, almost a year later, we received communication from them that they either lost or forgot to have us sign a couple of documents necessary to finalize filing our deed and title and remove my father's name off the property (he had co-signer our original mortgage). We replied immediately trying to coordinate getting this final paperwork signed. After some back and forth, we received no reply. A month later, in May, we get another email from a different employee asking again and stating they need us to sign the remaining documents. And again, we replied immediately and gave them all the appropriate contact details to arrange and coordinate signing. After several emails, we received no response and no word from them. It's been two months since we've last heard from them and we still do not have our updated deed and title to our home and it is not registered properly with our local county.

      I did just receive a reply from Mortgage Connect last night after I filed the complaint. They said they have all they need from me and are awaiting some updates from their notary. I'm still awaiting final completion of my closing (which should have been done a year ago) and an updated clean title to my home.

      I used Mortgage Connect as my title company on the purchase of a home which closed on December 3 2021. On March 2 2022 I checked with the county to see whether or not the deed had been filed (i.e., whether or not it was filed that I am the new homeowner). I found that it had not been filed and reached out to Mortgage Connect the following day. On March 4, they responded back and informed me that the recording had been rejected (and apparently they never attempted to re-record until I initiated contact). On March 11, Mortgage Connect informed me they resubmitted the info. On March 21, they said they are still "working on both the rejected recording docs" and will send another update by March 23. I have since followed up with Mortgage connect on March 22, March 28, and as of today (April 4) I have still not had any update. I also have no ETA of when this will be resolved. Since this is still not on file with the county, we are effectively not the registered owners of the property (and I would assume it's the same story with our mortgage company, of which the mortgage needs to be secured by the property).

      I am writing to file a complaint against Mortgage Connect Escrow. Mortgage Connect, LP was the Title Company for loan #********* which closed in February, 2021. The closing fees spelled out a property tax payment to Madera County due in March, 2021. In April, 2021, I received a delinquent property tax statement with penalties and immediately called LoanDepot. LoanDepot verified with Madera County that taxes were not paid. Madera County property taxes and penalties were paid by LoanDepot in May, 2021. At no time was I told that the property tax payment was an advance and would later have to be paid back. I fully believed the tax payment was taken care of after closing. Moving ahead to January, 2022, I received an escrow review that explained a shortage and I was responsible to pay it. After several phone calls to find out who I should speak to, I contacted ***** ********* *** ****** ******** During our conversation, I said that my wife and I received 2 checks from Mortgage Connect Escrow after closing. Check ******* in the amount of $1623.97 with a check stub message “Wire Overage” and Check ******* in the amount of $52.56 with a check stub message “Cash To Borrower” were received in the same envelope mid-February, 2021. I was told that I should have questioned the check amounts before endorsing and depositing the checks. I don’t understand why it is my responsibility to verify what Mortgage Connect Escrow is doing. This week, I paid the shortage from our savings account to keep our loan account current. Because this was a Mortgage Connect Escrow error, I am asking to be reimbursed for the tax payment in the amount of $1623.97. I also want you to find out how this mistake happened so that future borrowers do not have the same experience.       I have reviewed the response made by the business in reference to complaint ID ********* and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

      The check was received today, 3/3/2022, but will not be deposited. The explanation for the $500.00 is "Closing fee refund" as indicated on the check. I did not ask for a closing fee refund. My refund request was for the full amount of taxes $1623.97.

      Company was assigned to my loan closing, which occurred on 8/26/2021. They were to pay the taxes on the 3 parcels included in the deed/mortgage. As of today, 10/26/2021 they have not paid them and have not returned the money they withheld so that I can personally make the payments. Contacted them 3 times (9/24/2021, 10/18/2021 and 10/26/2021). All three times I was told they are looking into it and will call me back. NO RETURN CALLS as of today AND NO PAYMENT OF TAXES. I am now fearful that my properties will be put on the auction list due to delinquent taxes. I WOULD ABSOLUTELY NOT RECOMMEND THIS COMPANY FOR LOAN CLOSING PURPOSES.
