      To Marathon Studios:

Had you taken the time te respond to any of my 30+ emails, you would have bypassed a complaint with the BBB.

it was only today when I emailed you on your website to alert you, did you bother to respond.

I will close this now but reopen it if I find no other recourse. I see no entries for the current owner.

Well see. You should respond to people, especially when you are selling their info.

This business has a .org URL, called **********.org, that is actually run by a data broker with three different business names that I can find so far, ************************************************ LLC. It is run and owned by a man named *****************. They have published the name and contact details of every business that filed for and received PPP Loans, not only in SC but in the entire US. This information is easily found online by doing a ****** Search on your business name (or in my case, my first and last name since I am a sole proprietor.) This information should not be online. I realize this information is public record but SC businesses and business owners should not have their information easily exposed in this way.

      Hello,

Data on all loans received from the SBA has historically been subject to release under open-government laws, specifically 5 U.S.C. 552 (the Freedom of Information Act), and all PPP data is explicitly public under a December 2020 Federal Court order.

FederalPay.org is a website that publishes and makes accessible government records, including PPP loan data. Like other publishers of open government data such as ProPublica, FederalPay does not modify or remove any records.

As stated in the PPP data policy, please contact the SBA directly with any concerns regarding your PPP data. Any incorrect data reflected in your PPP record can only be updated by SBA.

Any redactions or changes made by the SBA will be reflected on FederalPay automatically, as well as on any other site that publishes the latest SBA PPP data.

      Hello,

You can find the same information on your PPP loan as published by FederalPay.org on the websites listed below.

      https://***********************/**************************/*******************-**********

      ******************************/*******************-**********

      https://********************************/**************/*******************-*******

We understand your concern, and hope that this helps you understand that your loan data is publicly available through a variety of sources, as is the loan data of every single recipient of a PPP loan. We are unable to provide any further assistance on this matter.

       Complaint: ********

I am rejecting this response because:

These other companies and SBA  are not listing my data online such that the results show up at the top of the first page of ****** search results, as yours is doing. And also - I am aware the SBA  has my data as public record, but who are you, and how do you gain financially from publishing my data?

      Regards,

*************************** and ***************** own **********.org and Marathon Studios, Inc. They publish publically disclosed personal information on his website so it can then be accessed via a ****** search. They earn profits from advertising and donations in doing so. This is universally considered a highly unethical business model as it is simply advertising personal information that would otherwise only be accessible on government websites for persons specifically looking for it. This information is then accessible via a simple ****** search of the person's name. I have notified them multiple times that they have incorrect information regarding my PPP Loan. I have provided proof that this information has been recognized by my lender and SBA as being incorrect, but they refuse to remove it from their website. The incorrect information is still showing on the most recent data download from the SBA website due to workforce shortages and volume of requests, so they refuse to correct their site.

We have corresponded with the individual numerous times concerning this issue.

The PPP dataset published on ********** has been synced directly with the latest dataset published by the SBA, and is regularly updated from this source. As published in our PPP data policy, we republish the data provided by the SBA exactly as provided, and do not make modifications or redactions to individual records.

If the individual's information has indeed been updated by the SBA to change the business name, the SBA has not yet published it to their publicly available data files. When the update is made to the SBA's public data files, our site will be automatically updated to reflect these changes.

We have no control or transparency over the SBA's process, and urge the individual to contact the SBA to request that their update be fully processed.

Some consumers may elect to not publish the details of their complaints, some complaints may not meet BBB's standards for publication, or BBB may display a portion of complaints when a high volume is received for a particular business.
