      We contracted ************************* in the fall of 2020 to build a gunite pool for us. **** was very disorganized when requesting payments the entire time, including making us write checks to another company as he dealt with problems with his own. We finally sat down in person with him to audit the entire 2+ year process this past spring and determined that he owed us $7000. He has not remitted this payment and has stopped working on our unfinished pool. We were also contracted for a gate in the front yard which he has also not done. He was refusing to take our calls for many months as well. The pool failed inspection for a variety of reasons that are his fault that are now our responsibility to remedy. These include, but are not limited to, failure to purchase and install a salt generator, failure to properly install perimeter fencing, failure to install front gate, failure to make the pool swimmable for the season (we eventually hired a new company for pool maintenance), failure to clean up the job site and failure to install app control for the pool heater which was promised. Also, ****************** attempted to plaster our pool via a subcontractor with the incorrect color. Furthermore, the plaster job was poor, with awful streakiness that could not be brushed out so he made the decision to paint the pool with an epoxy that is now already wearing as there is a coat of chalky material on the surface of our pool at all times that does not respond to vacuuming. The pool then becomes cloudy when we swim in it due to this material. I was told that to fix this will require sandblasting, replastering and refilling with water, all a cost to us as **** has completely dropped us from his radar. Clearly this should all be under warranty. I don't want any part of ****************** back at our house, but rather be made whole for the above issues.

      We signed a contract with Alan M********* of Indigo Pool Designs to do the following: Build 10x 20 **** deck/sun shelf with minimum 8" of water with bubblers and lights Construct retaining wall, stucco the wall, travertine capstone, steps to pool equipment, and back fill with top soil Purchase and install **** Stream Swim jet with 2 nozzles Waterfall with stone to match the house. Travertine decking and coping ********** (similar) plaster finish We have paid $155,000 of $188,000 due Indigo. The work has not been completed past 50% of the work required - Stairs have not been built nor material purchased; Swim jet not purchased or installed; coping and decking not completed; waterfall not completed; plumbing not completed; lights not purchased or installed; preparation for plaster not completed. Electrical to pool equipment was cut and not repaired; and demolition waste has been left on site since November 2021 after multiple requests were made to have it removed. There were ruts cut into yard during movement of bin blocks and he said they would be repaired but they have not. No one from Indigo pool has been on site to work since June 10th. Alan came by on 23Jun to ask for more money. I said no and requested a new payment plan commiserate with work completed. I have not heard from him since. I have had 3 pool contractors come by to re-bid the project. All 3 mention similar issues with the overall build and quality issues that needed to be corrected
