On 9/23/2022 I purchased a 2007 *** awd for 3700 with a salvage title. I purchsed the car with a temporary tag issued from Texas I assumed was real due to conducting business with a dealership. I purchased with the intention of tags being real, temporary and within enough time to get salvage inspection done in ny. On 10/12 the car was impounded for fraudulent tags and no registration that never existed on car after purchased. I paid $200 for sheriff and $190 for tow to drop off to my home. This means i drove from scranton Pennsylvania to Schenectady ny with illegal plates putiing my safety and life at risk. I paid $500 traveling fees to buy car. IF I KNEW THE TAGS WERE ILLEGAL I WOULD HAVE NEVER CONDUCTED BUSINESS WITH THIS DEALERSHIP. I did everything to rectify situation and he made it clear to me it was a scam all along due to the fraudulent plate ,no refund or even replacing the car with a car with a clean title as well plus my fees for damages. after i notified them about tags and police contact i was then told they purchsed tags off of ******** and i need to talk to them because he has nothing to do with it. Then to resolve the issue they offer me to drive or tow at my expense back to sell to his friend for 2300 after all the money spent and lost on my behalf. I've notified the district attorney in pa and the dealership the illegal tag was used for as well. I have all supporting documents as well and to resolve this issue I want my 3700 for car + 500 traveling fees+ 400 towing fees+;350 for insurance and gas wasted.Business response

I received your letter. I appreciate your mediation efforts to resolve this matter.The car was sold with salvage title and on As-Is basis (Bill of sale), the salvage inspection (enhance-inspection) was already done in PA so it was legal to register (road legal) in PA. In some states the salvage inspection has to be done again and in some states no need to do again.The buyer asked for a temp/transit tag, we don't issue any tags here, we found a company who issues temp tag, we contacted him and they issued a temp tag to the buyer, we have nothing to do with the temp tag.It is said that some states don't accept out-of-state temp paper tags. Buyer should be aware of his state laws and rules when driving a car on the roads. Before travelling to us, buyer was told that this is a salvage title and the car may need the salvage inspection again in his state (mobile text proof).It's buyer's responsibility to contact the DMV office of his state for salvage inspection. Instead, he was driving it around knowingly that it's a salvage title and the paper tags may not be valid in his state. When his car was impounded by police for some reason, he contacted us saying that the tag was fake. He couldn't provide any proof where the police said 'the tag is fake'. On his request we contacted the person who issued the tag, they said that the tag is genuine and they have been doing this for years.Buyer said he paid about $400 to release the car from police, as a gesture of goodwill we apologised for the situation and offered him $200 to help. He accepted this happily, we paid him right away through CASHAPP and he appreciated that and texted us back: 'that's an honourable move', he said he would need another car soon to buy from us'. So, THE ISSUE OF TEMP TAG WAS RESOLVED AND CLOSED THERE regardless of its status, he got compensated and car was released to him by police.Now I will come to the second part which is apparently the ACTUAL issue. When he contacted his state (NY DMV) for salvage inspection, they told him that the next available appointment is in 2023, that made him upset and from there he started pressurizing us to take the car back for full refund or he would complain that we did the temp tag fraud. He also falsely accused us for incomplete documents for salvage inspection. He offered an illegal act to mention the car as a gift so he doesn't pay state taxes (that's a crime), we said we couldn't do that. He was trying to find an excuse to return the car and get full refund.We OFFEREED HIM that we can give him a replacement car (2010 ****** ******) of same value with a clean title so he won't be worried about salvage inspection in NY, we do mostly salvage vehicles so that was the only clean title in the same value. He refused to take it. We said if he wants to sell the car we would buy it as per dealer purchase pricing and offered him the dealer wholesale value $2300 since he had used the car. He accepted our offer and committed that he would bring the car Friday morning. A day before he texted confirming that he was coming next morning with the car. We waited Friday morning; he didn't show up and never contacted us.After couple days he contacted us again making accusations and threats.He just doesn't want to go in the hassle of long process of salvage inspection in NY so he wants the full payment to be refunded.As we always do, we did this business too with honesty, without any bad intentions and tried our best to work with him after the issue started. Instead, he has been blackmailing and accusing us for fraud and running away from his responsibility to do the salvage inspection in his state. Luckily most of the communication between us was through mobile texts so we have all the communication to verify.Buyer's complaint contains lies, one of them is that we did nothing rectifying the situation by replacing the car with clean title.He doesn't have any reason to return the car. We also don't have any return policy unless it's sold with a warranty.
