      I paid $350 deposit for a Brittany puppy (please see proof of check cashed). Breeder, ******** ****** assured a full refund if transaction did not result in a puppy (please see email dated 1/7/2021). Late Spring 2021, I notified Breeder, due to a family issue, I could not proceed with transaction. At that time Breeder suggested deposit roll over to next litter mid-Summer 2021 and I get back to her. My family circumstance mid-Summer 2021 had not improved so I emailed requesting a $350 refund of deposit. Since that time I have made multiple attempts to contact Breeder requesting a refund of $350. Breeder does not respond.

      A puppy deposit is a means to show commitment to purchasing a puppy from a litter.  Industry standard is that deposits are nonrefundable unless the breeder is unable to provide the home a puppy.  We were able to provide ******* a puppy from this litter of pups, however, once the puppies were 6 weeks 6 days old we were informed that her sister required orthopedic surgery and would not be able to take a puppy.  ******* emailed that we were to keep the deposit as a means of compensation.  This is the industry standard as the deposit, aside intent to purchase, also serves as a retainer of fund to help, should someone back out, to find another suitable home.  This requires not just time but also results in costs associated with advertising as well as vet, feed, board, and labor costs to house the puppy until another home is found.  

       

      I have attached the email from ******* regarding her inability to move forward with the pickup and purchase of her puppy where she specifically addresses the deposit.

      Better Business Bureau:

      I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  

      According to the email response from Royal Flush Farms LLC to me regarding Royal Flush Farms LLC deposit Refund Policy, there were no limitations, stipulations, or conditions stated other than  
      if the consumer did not get a puppy, the consumer received a full refund. That email is considered a contract. The offer from me to Royal Flush Farms LLC to withhold the deposit was negated when Royal Flush Farms LLC proposed waiting for the next litter and at that time re-visiting securing a puppy, thereby supporting our original contract since no other contract was presented to me.   Royal Flush Farms LLC is entitled to alter their polices, of course, but not alter the terms of a current contract.
