      1-09-2023 $3000.00 Deposit on building, not a special order. The building was a left over from 2022 inventory. 1-13-2023 I called and told Crown International Steel Buildings salesman that the cost to of installation of electric was over whelming. SDGC electric wanted $30,000.00 to run electric up the mountain to the installation site of the building. Plus Fremont County Zoning told me I had to be a minimum of 50’ from the property line. Which is impossible because of the mountains would cost 30,000.00 in excavation. So we are talking 50 to 60 thousand just to get the building in and another 15,000.00 for the building. I was told to call another gentleman to get refunded. I called on 1-25-2023 and was asked by Damon to call back the following day. 1-26-2023 I called Damon he’s in charge of refunds. I was told they would give me $1500.00 back. I saved for years to buy a building, I’m a 85% disabled and I cannot afford to give away $1500.00. Nothing has or had been set up for delivery or other payments. I’m asking for a full refund of $3000.00, I received no services from them or materials.

      To Whom It May Concern:
      In response to your chargeback letter, *** **** contacted us over the internet through our website about information for a steel building kit, back on December 17th 2022. We contacted him by phone and email. We agreed to a price of $15,000.00 for a steel building kit. We sent him a contract and a credit card slip to sign for a deposit of $3000.00. We received his signed contract and credit card slip back on January 10th 2022. The deposit he paid on his credit card was for the Building Erection Manuals and Manufacturer stamped drawings which we sent by UPS and he received them on January 16th at 9:57am. We pay an independent engineer to load check the building to make sure it's meets the snow load and wind load requirements for the area and put the loads onto the stamped drawings. *** **** contacted us on January 21st and said he wanted to cancel because it would cost too much money to run electrical to where he wanted to put the building. This is something that *** **** should have and could have investigated before he purchased a steel building kit. The contract he signed states the deposit is non refundable, however we did offer to refund him half of his deposit.

      I contacted them about a shed and explained to them where I live and they assured me that that would not be a problem.so I played a down payment to receive a stamped set of engineered drawings which I never received and the county will not allow the type of building I was going to purchase.

      *** ***** purchased a steel building kit from us.  He signed a Contract and gave us an Engineering Deposit.   We sent him Florida engineered stamped drawings and design load calculations which he received on Oct 4th 2021 at 10:35am via UPS.    We look up area requirements for snow load, wind load and seismic loads so that we can provide a kit that structurally meets.  The Independent Engineer we hire to stamp the drawings also reviews the Building code for the area to ensure the building structurally meets the code requirements.  Zoning is not in the scope of work for a structural Engineer.  We do not guarantee someone will be approved for a building permit.  We are not responsible for Zoning or neighborhood by-laws or setbacks as we are simply providing materials for a kit and we are not a general contractor pulling permits.  *** ***** is responsible for checking with his zoning department and HOA  before he makes a purchase.  We have attempted to contact *** ***** and give him a  partial refund of his deposit.   I have included the UPS proof of delivery for the Engineering package.

      First *** ***** claimed that he did not receive the Engineering Package we sent him. Now he admits that he did in fact receive it but the drawings were incorrect.   The Building is designed properly for his areas snow and wind loads, The building code requires 141mph wind speeds and the building was stamped for that requirement and actually meets up 10 169mph. *** ***** was not denied a permit from the building inspector due to the building being insufficiently designed or underloaded.  

       *** *****'s Zoning Review has denied his permit due to him being in a residential area and they do not allow metal buildings or quonset huts.  This is beyond the Engineers scope of work, and is the responsibility of the home owner.  I have attached an email from his zoning department.We do sympathize with *** ***** that he cannot put up a steel building in his neighborhood and we are willing to give him a partial refund of the deposit he paid even though the contract he signed states the deposit is non-refundable and release him from his contractual obligations.

      The above referenced permit has been reviewed for Zoning compliance. The permit has been rejected for the following reasons:

      Per Sec 124-173: Quonset huts are prohibited in all residential districts
      All accessory structures with a roof impervious to weather and exceeding 150 square feet in floor area up to 300 square feet in floor area (except carports and gazebos) in the RSF, RMF and RC Districts shall have a similar exterior appearance (excluding roof materials) of the principal structure.

      I have reviewed the response made by the business in reference to complaint ID ********* and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

      [To assist us in bringing this matter to a close, we would like to know your view on the matter                                                                                                                                                                                         that is a lie.the first set of drawings did not have engineered stamp and the second set has a wind calc of 140mph.florida has wind load of 150mph.these people have done nothing but lie to me from beginning.
