On 2/6/2021 I entered into a contract and paid a 10% deposit for installation of an inground pool during the 2022 season. In 2/2022, I received a call and was told to apply for permits as installation would be soon. I didn't apply because I never heard back from him again. I called several times with no response. Out of the blue on 7/8 I receive a text that stated tentative ETA for install was now 8/15. At this point, I applied for and paid $535.00 for the necessary permits. 8/15 install then became 8/23. He claimed that the pool kit had been backordered. I have since learned it wasn't backordered. On 8/25, he shows up with a huge excavator that did not stand a chance of fitting through my gate. He stated he would be back on 8/27. He was a no-show. I reached out to him on 8/28 and he said that he would now come by with the excavator and pool kit on 8/29. He delivered excavator claw and pool kit on 8/29 and stated he would be back to start digging that afternoon. He informed me that the 2nd installment check (70% of project costs) was due since he was going to start digging that afternoon. We made small talk and he nonchalantly mentioned that he could not honor the price on the contract. Not once had he mentioned increased costs until this day. I was surprised as we had a contract that does not include language for material increases. He also couldn't tell me what the new price would be. He flat out said he would not install the pool for the price in the contract. Three days later he took it upon himself to open my lock and let himself into my yard and removed his equipment without my approval. After requesting, he returned my 10% deposit the next day. I would like to be compensated for the cost of permits, damage done to our yard with his equipment when he delivered his materials, the cost of the deck we got rid of thinking we had a new pool coming and the cost of the above ground pool we completely let go thinking we were getting an inground pool.
