      On or about December 1, 2022, Murray Plumbing, Inc. serviced my property at **** **** ****, Harrisburg, PA ***** for an exterior sewer line problem. While working on the exterior line their employee, Mr. Murray struck the top of my lamppost with a machine and knocked off the solar light fixture, which shattered upon falling to the ground. In January 2023 I contacted Murray Plumbing about the damage, particularly the mess to the shrubs, sidewalk, and damage to the solar light fixture. I spoke with Mrs. Murray. Mrs. Murray said that she was aware of the damage. She wanted to verify my contract with ******* **** Warranties of America for restoration and would be in contact with me. She never returned the call; however, in February, an agent from ******* **** Warranties of America called to explain that my contract did not include restoration, and therefore Murray Plumbing nor ******* **** Warranties would be responsible for damages. To the best of my knowledge, I do not recall this option being offered or discussed. On March 7, 2023, I mailed a certified letter to Murray Plumbing. The address was verified by one of their employees and double-checked with the Better Business Bureau. According to the post office tracking system, the letter reached the Middletown post office on March 8th. However, Murray Plumbing did not take delivery of the letter and it was returned unopened on or around April 15, 2023. As of that date, I filed a complaint with the Office of The Attorney General. I received a copy of Murray's response. They claim during Christmas time they were looking for a $20 replacement solar light. I did not contact Murray about the damage to the solar light until January; however, Mr. Murray knew he damaged the fixture in December. I received a receipt from The **** ***** in March for a replacement solar light fixture for $120.84. At no time did I ask Murray Plumbing to paint my home. I only asked for my property to be restored and to be reimbursed for damages.

      On December 01, 2022  we serviced the property at **** **** ****  Harrisburg PA  *****.  I will attach all supporting documents. 

      We were called  by ********* USA which is known as ******* **** Warranty.  We had found we needed to dig. ****************************

      I obtained permits and proceeded to prepare for the dig.  ****** ******* was informed  of what was going on.

      While we prepared for the dig, ****** ******* called in another claim on the 8th of December. 

      We explained that she did not need to open another claim. We were still working on this. We tried to prepare her for what was going to go on.  It helps to be less traumatizing for the customer when things are turned upside down.    

      When we finished we explained the ground needs to settle because it is cold and we cannot lay cement at certain temperatures.

      We explained we would return.  She called many times.  Wanting her yard restored and concrete finished.  

      We received a call from HomeServe stating ****** ******* was on the other line, she wanted to 3 way her in so we could talk, she explained what *** ******* wanted.

      The customer Service rep explained, ** ******* was requesting the Warranty Company and Murray Plumbing needs to power wash  her home and then she wanted it painted.  She explained that she wanted the sidewalk finished.  We tried to explain to her,

      We cannot lay concrete in temperatures below 50 degrees.  ** ******* was not having. it.  I told her we would get her sidewalk done but I couldn't warranty because of the weather.  I sent an employee to see what was going on at her house, she explained there was mud everywhere. 

      She had mud on her window and I sent him with cleaning supplies to clean her house up.  She sent pictures with him to give to me.  There is no light in these pictures.  ** ******* states she sent a certified letter.  I have not received it.  I am in the office everyday. And I receive mail and deliveries everyday.

      She told me of a light that was broken and I explained I would check into it.  She explained it is solar powered and it was only like $20.00.  I tried to find one in the store and was unable to locate one at Christmas time.  I tried several stores and found no solar light pole light for $20.00 or even a solar powered light.  I have no idea what the light looked like to match  it up with.  Clearly ** ******* provided a receipt for well over $20.00

      Homeserve explained to her, these items are not covered under restoration. A claim was again opened by ** ******* on December 28, 2022 for restoration, she was explained what is and is not covered by HomeServe.  Which is when we did her sidewalk against our judgement because the cold weather will not allow the concrete to cure properly subjecting it to cracking  and not lasting long.

      At the time of the dig, ** ******* Called about her shrubbery, she wanted it gone, then she wanted us to fix and plant them.  We explained to her, we are not landscapers and her restoration is limited to seed and straw.  Mulch and flowers and shrubbery are not covered.

      I have pictures of her work completed (sending in separate email). 

      The waiver was signed. And  I have tried to accommodate ** *******.  My apologies for any inconveniences.  I will  say that ** ******* has made  many demands  on recorded telephone conversations demanding we paint her home.

      I was told the light was $20.00 now I receive a letter for $120.84 from the Attorney General's Office.

      I am not sure what stance to take on this other than she originally wanted $20.00 and now 6  times that amount?

      I would not paint her house and I will not pay $120.84.

      I wish to have a happy customer because we live and work in and with our community.  The most I would have been willing to do was give her $20.00.  At this point I am only open to discussion.  

      Please let me know if you do not receive the pictures, I will resend or send in a different manner.

      I am rejecting this response because:

      The facts provided by **** Murray of Murray Plumbing; Inc. are not entirely true. Although photos may have been taken, and various work permits secured, After reviewing the signed wavier and work order/ invoice. I am adamant that I did not sign these documents. I always sign my name as ****** ** *******. Both the wavier and work order/Invoice are different signatures and signed as ****** *******. I can only surmise, that these documents were signed by someone other than myself. It appears that the documents were intentionally signed in my name to enter into a contract without full knowledge or understanding of the terms and conditions.  I see this signature as fraudulent and have proof of my signature. 

      In her reply to the Office of the Attorney General she claims on page 2, paragraph 2, sentence 3 states the following: (**** ******* has made many demands on recorded telephone conversations.)  I would like to add that I never gave my consent to have my conversations recorded. Pennsylvania is a two-party consent state.  It is unlawful to record telephone conversations without consent.  

      The tracking number by the U.S. Postal Service shows the date the certified letter as mailed to Murray Plumbing was on March 7, 2023, and received in the Middletown post office on March 8, 2023. ( I have this document and will provide, if needed)

      The decision concerning the cement was suggested by Mr. Murray. I wanted the original cement slab put back in place.  However, when he did so, it was raised creating a trip hazard.  He then claimed it would be best to replace the slab. The hour was late so he said he would return to fix the area when the weather permitted. When a technician came back to my home to complete the cement work he noticed me cleaning the mud off the side of my house and offered to help me. At this time, I gave him photos of the damaged solar lamp light.

      In January, 2023 I recall speaking with Ms. Murray about the damaged solar lamp light. I did not tell her the cost of the solar lamp light. I was not able to quote a price until I found a comparable replacement. 

      In February in spoke with (*******) a service representative from **** ***** , She suggested that a 3 way conversation would be helpful to clear up any confusion about restoration in my contract. I recall this conversation; however, do not recall the many telephone calls Ms. Murray is referring to. 

       I would like to reiterate; at no time did I ask that Murray Plumbing paint my house.  I merely asked that they clean up their mess and take responsibility for the damage they caused.
