On 10/28/21, **** ***** and I entered into a contract for work at my residence. ***** agreed to work in the kitchen, 1st, 2nd and 3rd floors. This included installing insulation; hanging, finishing and painting drywall; installing cabinets and appliances in the kitchen; and removing three air conditioner units. The total contract price, including materials, was $17,525. ***** required payment of a deposit equal to half the total agreed upon price before starting. The contract provided that ***** would start work on 11/1, and complete work by 11/30. The schedule, scope of work, and total cost were the result of negotiations after multiple walkthroughs. On 11/19, ***** requested an additional $1,420 for work that ***** admitted he had overlooked. On 11/23, ***** increased the amount to $1,825, but agreed that he would not make more requests. Contrary to assurances, ***** then demanded a prepayment or draw on the final balance, which was not due until completion of the project, in the amount of $2,000 on 11/29. I did not agree to a prepayment of the final balance but agreed to give ***** another $1,600 after signing two additional kitchen and bathroom sales agreements for materials. But the materials never arrived. Between December 6 and 15, ***** showed up for work only one day for two hours. On 12/16, ***** showed up at my residence with another man and demanded more money. ***** admitted that he “underbid" the job to win and that materials were more expensive because he waited to purchase them. During a heated exchange, ***** told me he would stop working on the project unless I paid ***** more money. ***** and the other man then packed up and left with no resolution. On the day of the confrontation, the project was 16 days past the agreed upon completion date. I had already paid ***** $13,187. ***** acknowledged that only about $4,600 of work had been completed. I have paid ***** $8,587 for work that has not been completed. ***** will not respond at all.
