On or about February 26, 2024, I entered into a written agreement with Thomas H*** for landscaping services at **** ********* ****** ************ ** ***** for a price of $1,800. See Exhibit 1. The services included installation of a mulch bed including rubber mulch for a playground and construction of a playground.
On or about March 3rd, at Thomas H***’s request I paid Thomas H*** a $900 cash deposit for the materials to complete the services.
On or about March 4th, Thomas H*** started performing the services using a Bobcat Skid Steer. See Exhibit 2. On or about March 4th, through his negligent operation of the Bobcat Skid Steer Thomas H*** caused significant damage to my yard. See Exhibit 3.
On or about March 4th, our Invisible Fence wire was broken in the side yard where Thomas H*** was operating his Bobcat Skid Steer. The wire was fixed by the Invisible Fence service team for $327.54. See Exhibit 4.
On or about March 4th, Thomas H*** left my property with the stated intention of returning March 5th to complete the mulch pit and repair the damage causes by his negligent operation of the Bobcat Skid Steer. Thomas H*** did not return on March 5th.
Thomas H*** ignored all attempted contact by me on March 6th and March 7th. On or about March 10th, Thomas H*** confirmed that the project would be completed by March 22nd and stated that he would be coming on March 11th to finish the mulch bed in preparation for the swing set to arrive on March 15th.
On or about March 11
th Thomas H*** did not come to my home to finish the mulch bed and Thomas H*** ignored all attempted contact by me on March 11th. On or about March 14th, Thomas H*** stated that he was not going to skip town with the money and he would be coming on March 16th to complete the mulch bed, repair the damages to the yard and build the swing set.
On or about March 16th, Thomas H*** did not come to my house to perform the work blaming lack of help. Thomas H*** ignored all attempted contact by me on March 17th and March 18th.
On or about March 19th, Thomas H*** stated that he would be coming on March 25th to complete the mulch bed, repair the damages to the yard and build the swing set.
On or about March 25th, Thomas H*** did not come to my house.
On or about March 26th, Thomas H*** stated that he would be coming March 27th to complete the mulch bed, repair the damages to the yard and build the swing set.
On or about March 27th, Thomas H*** did not come to my house instead stating he would be coming on March 28th to let the yard dry.
On or about March 28th, Thomas H*** stated he was getting mulch and then coming to complete the mulch bed, repair the damages to the yard and build the swing set.
On or about March 28th, Thomas H*** did not come to my house and ignored all attempted contact by me.
On or about March 29
th, I sent Thomas H*** a notice letter terminating the Agreement. See Exhibit 5. The notice letter demanded a refund of all payments and the damages to be rectified to their original condition.
On or about April 1st, Thomas H*** stated he would return the deposit and $300 to repair the damages by April 4th. I informed Thomas H*** that I would need to obtain an estimate for the cost to repair the damage.
On or about April 1st, I obtained an estimate from ****** Landscaping for $975 to repair the damage caused by Thomas H***. See Exhibit 6.
On or about April 1st, I ordered 3,000 pounds of rubber mulch from rubbermulch.com for $1322.88. See Exhibit 7.
On or about April 2nd, Thomas H*** agreed to pay me $1,250 to refund all of my payments and partially pay for the damages.
On or about April 8th, Thomas H*** contacted me and stated that he planned to pay me on April 10th. Thomas H*** ignored all attempts to coordinate the payment on April 9th and April 10th.
On or about April 9th, ****** Landscaping completed the mulch bed and put the rubber mulch into the bed.
On or about April 12th, Thomas H*** contacted me and stated that he planned to pay me on April 13th. Thomas H*** ignored all attempts to coordinate the payment on April 13th.
On or about April 15
th, *** *** ***** *** *** built and installed the swing set for $700.
On or about April 16th, ****** Landscaping repaired the damage caused by Thomas H***’s negligent use of the Bobcat Skid Steer. See Exhibit 8.
The total cost for ****** Landscaping to complete the mulch bed and repair the damage caused by Thomas H*** was $2,800. See Exhibit 9.
On or about April 17th, Thomas H*** contacted me and stated that he planned to pay me before April 22nd. Thomas H*** ignored all attempts to coordinate the payment on April 22nd.
Including the $900 deposit paid to Thomas H***, the total expense to complete the originally agreed upon project and repair the damages caused by Thomas H*** was $6,050.42.
Upon information and belief, this is not the first time Thomas H*** has done this to a customer.
