      My spouse *************************** and I booked the banquet hall of Indian Grill on 22 March 2022 for celebrating our 50th Wedding Anniversary on 2nd July 2022. We discussed the details with Ms. S***** of Indian Grill and signed a contract giving an initial deposit of $500 enclosed as Exhibit A. On or about 15 May 2022, *******’s younger brother suffered a massive brain hemorrhage and we had no choice but to cancel the event so I called Ms. S****** on 18 May 2022 and canceled the event. Since there was no clause regarding the return of initial deposit of $500 in the contract and it was a very unusual and extenuating circumstances, I requested Ms. S****** to return the deposit giving her more than a month and half notice and she agreed. There was no response from Ms. S****** so I sent her a text message on June 4, 2022 submitted as Exhibit B. I did not get any response from Ms. S****** till 3 July 2022 so I called her again and received a text message on 3 July 2022 shown in Exhibit B. I didn't get any response from her till 5 July 2022 so I sent her another text message on 5 July 2022 shown in Exhibit B. I called her again on 6 July and had a long discussion but then she refused to return the initial deposit of $500 inspite of the fact that there was no clause in the contract forfeiting the initial deposit in the event of any cancelation.

      My name is Sheetal B***** . I manage the Indian Grill Banquet. 


      I am attaching a few documents which can clearly show that I have shared the contract documents with ** ******  Via text on March 22nd at 11:03 AM ( page 1) . Which clearly states that the deposit is non refundable because once you book the event that date and time is no longer available to the public and also we use that deposit to book the servers and the bartenders because we need staff to assist the event.


      ** ****** was aware of the information that if he would cancel it then he would lose his deposit. 


      *** ******  actually booked this same  event before with the ****** ** **** in Fort Washington . Then he visited our venue and liked ours better . He told us that he has given the deposit there as well via credit card and he will get his money back by putting the transaction in dispute. 

      You can clearly see our conversation on page no 2 where *** ******  asked us to keep the check but not to deposit it until he gets his money back


      We held ** ****** ji’s 2nd July event booked and said no to the other inquiries for two months. After two months he just called and said he can’t do it because one of his relatives is in hospital in india. I understood his situation and asked him if he wanted to postpone it but he clearly said no and asked for his deposit back.


      I am willing to give him 6 months to use that deposit.


       I really want to work with ** ****** and hope he will understand our efforts
