    Dear *** ********* On the evening of July 3, 2021, Zambelli Fireworks were displayed at the site of Centennial Terrace and Quarry in Sylvania, Ohio. On the morning of July 4, 2021 I found that my driveway was covered with fine black particles, along with pieces of tan colored paper that neighbors said constituted fallout during the fireworks display. My sidewalks and walkway were also affected. Because of the way my property is situated, my driveway had the most of this difficult-to-clean material. But the same materials were scattered on the sidewalks and driveways in my immediate neighborhood. Cleanup of my property was a lot of work. I contacted the city of Sylvania to report the fireworks fallout mess and to ask about safety and cleanup concerns and responsibilities concerning future fireworks displays. On Monday, October 4, 2021, two city officials, a neighbor and I met at my home to discuss the responsibilities of safety and cleanup. In answer to my request, ***** *****, City Service Director, and ****** ********, City Law Director, brought to me a copy of Ordinance No 15 - 2020 which authorizes the agreement concerning the July 3rd fireworks display. On page two of the Contract and Agreement, item No. 8, they referred to the sentence that begins "Zambelli shall be responsible for the removal of unexploded fireworks and the cleanup of material debris, etc." I understand this to be the main reason our city officials recommended that I contact Zambelli about the fallout and cleanup issue. Because this fallout has not happened to my property in the prior 17 years I have lived here, I do wonder what may have been done differently. A couple of neighbors did say that the fireworks display seemed to be closer to us than in prior years. On October 8, 2021, I sent an Email to Zambelli requesting an assurance from them that - should there be fallout particles from their fireworks displays in the future, cleanup would also include my driveway, property in general, and other affected areas in our neighborhood. On October 19th *** **** *****, Project Manager of Zambelli, responded via Email that Zambelli is responsible for clean-up of basically the parking lot next to the water tower. He explained that according to Google Earth, my property lies approximately 1,500 feet outside the Discharge Area. Therefore, he feels Zambelli is not responsible for any fallout mess on my property or otherwise from their fireworks. His information: ******************************* ****** ************ I am 83 years old, and for me it was a time consuming hardship to clean up the fine particle mess on my property on July 4th of this year. Where explosives, fallout and pollution are in play, certainly responsibility also has to be a factor, especially when something goes amiss. As Zambelli is responsible for the fireworks, it would make sense that Zambelli is also responsible for the debris and pollution that result from the fireworks. So I am hoping that you will kindly become involved in determining Zambelli's responsibility for cleanup and resolution of this messy - and possibly dangerous situation, should it happen again.
