My husband and I filed a small claims appeal on 03/31/2022 regarding a judgment made against us in Municipal Court on 03/02/2022. We filed the paperwork in person at the Prothonotary office in Philadelphia's City Hall. It is required that the opposing parties be served a copy of the Notice of Appeal and the Standing Case Management Order. We were referred to Metro Filing by one of the office employees. We contacted Metro Filing by phone in April, we spoke to Michael and provided him with all the information about the opposing parties that we had, as they were no longer living at the address listed on their initial complaint. He explained the process in detail as well as the cost. He even offered to pick up the paperwork from us at our residence, which he did and we paid him at that time. We followed up with him sometime in May via phone to see if the parties were served. At that time they hadn't been, but he was working on it and we knew that this was not going to be easy as the parties were doing their best to avoid being served. We were confident that service would be completed and that Michael was using every option available and necessary to get the job done. We asked to be notified once service had been completed. Our court date was scheduled for June 15th. We called Metro & Michael told us that he believed service was completed, he would check his records. He never got back to us. When we went to court we were told that the Proof of Service was not filed and our hearing is rescheduled for July 20th. I have spoken to Michael twice asking for the paperwork to be uploaded & attached to the court docket. He promised to do this over the Fourth of July weekend. As of today, there is no Proof of Service on file as per the Prothonotary Office. I have left voicemails & text messages requesting a call back & a copy of the Affidavit of Service for our records and for us to submit to the court on July 20th ourselves if need be. WE ARE IN NEED OF DOCUMENTATION FOR COURT!
