In the fall of 2019 I hired Eugene K****** to complete several home remodel projects. Among the projects was the completion of a deck. As of the fall of 2021 the deck has not been completed. Eugene K****** stopped showing up to perform any work and I have since hired another contractor to complete his work. Additionally, the work on the interior of my home that he performed is faulty. He remodeled two bathrooms, in both of which the showers leak water. The upstairs shower has damaged the ceiling below. Both showers need to be completely torn out and redone and the ceiling will need repaired below the updstairs bathroom. I am seeking financial compensation for the completion of the deck that Eugene K****** did not perform as well as financial compensation for the remediation of two leaking showers and ceiling drywall repair.Business response

I am writing in response to the complaint made against me, Eugene K******, by ******* ******* ** ********
In the complaint *** ****** stated that that he hired me in 2019 to do various home remodel projects and that I stopped showing up to work. He also states that the interior work that I did was faulty. Neither of these complaints are accurate or truthful. *** ****** has left out many details that prove his complaint to be inaccurate.
When I was hired in the fall of 2019 it was to remodel the entire home (interior), an addition, and to build a small deck on the outside. In the contract I did not include any plumbing, HVAC, electrical, and any other subcontractors in my contract. *** ****** was responsible for paying all subcontractors and working out a contract with them. Therefore, any plumbing issues from either bathroom would not have been my responsibility. I began with the interior of the home first. The upstairs is where I started in which the two bathrooms he refers to are located. We finished the upstairs first and was completed in the beginning of 2020. It has been completed and finished for over two years now. In the past 2 years *** ****** has not brought to my attention any issues from the bathrooms upstairs. I worked at this location all the way up until January 7-14th, 2022 before I was forced to leave the job due to non payment from *** ******. He had many opportunities to mention "faulty" work to me up until that point.
When the inspector came to do the final inspection for the actual house, he informed me that the attached deck to the house would require a separate permit to continue building the deck. This was around January of 2021. I informed *** ****** that he needed to apply for a deck permit with Marshal Township in order for me to continue. At this time I gave *** ****** the drawing I did for the deck we agreed on in the contract and a list of materials that would be needed to complete that same deck. *** ****** did not get the permit for me to begin working on the deck until around the end of June/beginning of July of 2021. During that 6 month gap I had to start other projects due to *** ******'s delay in getting the permit. When he did receive his permit I informed him that I would not be able to begin work for about 4-6 weeks because I was finishing up other projects.
In September of 2021 I started working on the deck after the permit was granted, *** ****** informed me that it was the same deck from my original drawing (which he kept) with the same specifications. I later found out that *** ****** made a different drawing in which he submitted for a permit. I had already spent a lot of time framing out the original deck from the drawing when *** ****** gave me a completely different drawing. At this point I had to tear down 60% of completed framing to reframe according to the new plan. Additionally, this new plan was a lot more lumber and labor than the original plan. When I spoke to *** ****** I told him that this was going to cost more money and he agreed to pay the additional labor costs. I also was not given the opportunity to review the drawing before *** ****** submitted it for approval through Marshall Township, but *** ****** put my name down on the application without my approval or signature.
After a discussion with *** ******. I informed him that it would cost about $5000 more for the new plan. He agreed to pay the differential. So I continued to work on the deck and I had been financing the materials on my own (which I have all the receipts for) with the original agreement that I would be reimbursed. I continued working without being paid until I had exhausted all of my finances for this job. I then requested *** ****** to give me a partial payment for the materials purchased in the sum of approximately $3000. *** ****** refused to pay me. This is the point in which I told him that I can no longer continue working for free and he needed to pay me. He did not pay me so I was given no choice but to cease work. This was in the first or second week of January of 2022.
When I started the deck after the permit was acquired in September of 2021, *** ****** gave me $6000 towards the original $18000 agreed upon in our contract for labor only. With the changes he made to the deck, he agreed to an additional $5000 in labor costs bringing the total cost of labor to $23,000 once the deck was completed. I have receipts for approximately $7500 in materials in which he agreed to pay for. His initial draw for the deck does not even cover the costs I spent on material let alone any of my labor costs. There is no way I could continue working on this project without being paid. When I brought to his attention that I had my own bills and mortgage to pay and could not continue to not be paid he stated to me "You just bought a house at 60 years old, what did you do before then?" Making a point to say that I managed without a house before and I can do it again. Any logical person does not work for free. I would not walk away from a job that the end result would be over $24K more dollars in money for myself. When you do not get paid, you cannot continue to work. I would have loved to stay on this project and finished it and received my money. *** ****** made it clear that he was not going to pay me for my services and the materials I purchased. In all the years I have been in construction and remodeling I have never had a single complaint filed against me. This is a far cry from a client that is trying to find a way to get out of paying for a job that he was under contract to pay for and my name should never be defamed because of it.
