      A daycare requests parents to pay $350 annual "school supply fee" to place their children on a wait list, even before the child is offered a place in the school to use the supplies. The school requires parents to file a contract when going on the wait list. The contract is clear in that the fee can be refunded if a parent requests to be removed from the wait list before a spot is offered. In this specific case, the parent requested the child to be removed from the wait list before a spot was offered and the fee is refunded. The parent requested this 3 months after the desired start date. The school is refusing to refund the $350. The school states that because over 30 days have passed, the family is not eligible for the refund. This is not stipulated in the contract. The family would like the $350 refunded to them since they are requesting immediate removal from the wait list.

      Please be advised that the law firm of Eckert Seamans Cherin & Mellott, LLC represents the
      interests of La Scuola d'Italia Galilei Galilei, Inc. ("Scuola") in connection with the complaint that
      Ms. ***** ***** submitted to the Better Business Bureau. The Scuola denies that it violated the
      Enrollment Agreement ("Agreement"), its policies, or any applicable law and it maintains that the
      complaint lacks any merit whatsoever.


      On December 20, 2021, Ms. ***** and Mr. ****** ***** executed the Agreement for their child
      to receive educational services and care at the Scuola. The Agreement incorporates the Parent
      Handbook by reference thereto. The Parent Handbook requires a family to pay a yearly supply
      fee in the amount of $350.00, which a family must pay even if the family is on the waiting list.
      See Page 2. It, furthermore, states, in pertinent part, the following: “If you desire to remain on the
      waiting list and wait for a spot to open, you are agreeing to remain on the waiting list until a spot
      becomes available. No future refund will be given.” See Page 3.


      Here, the family requested a start date of January 3, 2022. The family thereafter communicated to
      the Scuola on several occasions that it wanted to remain on the waitlist even though the original
      start date passed. On April 28, 2022, the family arbitrarily demanded a refund of the supply fee
      because it enrolled its child elsewhere, despite the fact that it repeatedly requested to remain on
      the waitlist. In this instance, the family was not eligible for a refund because it indicated that it
      wanted to remain on the waitlist.


      We welcome the opportunity to provide further information if it is necessary to respond to this
