      Realtor Evan B********** stated that I would receive a refund on a deposit on a house he incorrectly informed the seller I was taking. He stated that a refund of $2000 would be received after 4/6/22. As of 4/16/22, nothing has been received. Calls to the owner of the business have gone unanswered. I would like my $2000 immediately

      The complaint filed on April 20 is factually incorrect. I spoke to the complaintant on the phone as did her agent Evan B****** - multiple times - and she does not understand the real estate contract process. We represented her in the purchase and explained the process to her, but she seems to still not comprehend how real estate law works. The buyer put an offer on a property that was accepted, and sent $2000 earnest money to the listing office (not our company). The check was cashed per Pennsylvania law after receiving it by the broker. The mortgage process was started and she applied for a loan. She then changed her mind and decided not to purchase the property after reviewing the inspection reports. There was miscommunication between the parties. The lender explained that in order to follow the contract timelines, the application was put in and the appraisal ordered. The buyer was not happy but does not understand these were submitted before she changed her mind. She terminated the deal in writing, which is fine. However, the termination must be signed by both parties, buyer and seller in order for the $2000 to be released. Seller refused to sign - and we cannot force him to do so. The process is that the contract states the buyer may then request their money back after waiting the prescribed time frame stated in the contract - which was April 6. On April 6 Evan B****** formally requested the money back from the listing broker. Per the contract, the listing broker then has 30 days from April 6 to refund the money. This is in writing in the PAR standard contract. This was explained to the buyer. She demanded the money be returned immediately, which we cannot do as we are not holding it. Ramus Realty Group is not holding her money. The listing broker holds it per the contract. We have no access to return the money. We have done our part and requested it on April 6. We returned her calls in a timely manner. We have done nothing wrong. 
      The listing broker replied on April 6 that she would review the file. On April 25 we again requested the earnest money be sent to the buyer. The broker apologized for a delay and sent us a copy of the returned escrow. Legally she had 30 days to return it, and she sent it back to the buyer 19 days later. She is within the contract parameters. We explained all of this to the buyer when she first terminated the contract.

      I am rejecting this response because: regardless of having the money returned which took several weeks, the relaltor refused to show me homes which I could have purchased causing me to have emotional stress and not having a home to live in. Business has poor business practices and has me at risk of homelessness.
