    The Insurance Department of the Commonwealth of PA v. Seguro Medico LLC

    The following describes a government action that has been resolved by either a settlement or a decision by a court or administrative agency. If the matter is being appealed, it will be noted below.


    On November 1, 2022, the Insurance Commissioner for the Commonwealth of PA (Department) and Arthur Walsh settled (Consent Order) for alleged violations of the insurance laws or regulations of the Commonwealth. According to the Consent Order, Walsh's agency provided sales scripts to employees which contained false statements including that its employees "work with all 37 A-rated insurance carriers" when that was not the case; provided false sales scripts to employees to be used when selling policies, stating it searched the entire market and provided consumers with the most amount of benefits at the most affordable rate, yet it only offered a specific coverage and had not reviewed everything available to the consumers; and provided false statements about its agents being "one of the top agents in your state" and being a "non-commissioned agent" when the agent in question was not the top agent in the state and was paid incentives/commissions based on the sale. Walsh's employees, using these false scripts, made the insured customers believe that they had purchased policies with full medical coverage that covered pre-existing conditions and surgeries and identified themselves to consumers as "The National Enrollment Center" and "The Health Enrollment Center" when receiving incoming calls instead of by its registered name.


    The Consent Order states the Respondent also allowed an employee or employees to submit at least 5,669 applications for insurance under his name, 102 insurance applications under the name and license number of another agent who was no longer working for him, and allowed an employee to submit at least 12 insurance applications under the name of a licensed producer after they had left employment with Walsh’s company.


    As a result of the Consent Order, Walsh agreed to cease engaging in any unfair insurance practice, fraud, forgery, dishonest acts, or an act involving a breach of fiduciary duty, civil penalty, and suspension and immediate surrender of all licenses to do the business of insurance.  The consent order is effective immediately.

     

    Walsh's attorneys have advised the BBB that they filed an emergency petition to stop enforcement of the Consent Order. Walsh's filing argues that the Consent Order was obtained unconstitutionally by failing to provide adequate due process consideration in reaching the Consent Order. That matter is now pending in litigation.

    Two weeks prior to March 2, 2023,I had purchased an insurance plan for $85.00 per month to help with upcoming dental procedures. When I presented it to the dentist office, they said they had never heard of such coverage and that they were sorry they could not honor any discounts. On March 2, 2023 I spoke to a representative about the coverage I had purchased. I told him that the coverage was useless. He said he suggested to get a full comprehensive plan for $2464.68 a year and that everything would be covered. He went as far as to say that my dentist was on the plan - which was a lie. I agreed and electronically signed to allow payment. After this conversation, I called the dentist who was doing the procedure and they said they are not in the plan. So I wanted to cancel that insurance. I tried to cancel but hey gave me the run around and would not supply a refund. I called the credit card company and had a stop payment on the payment. The credit card company refunded me the amount while they investigagted. After two months, the credit card company said that they contacted Quck Health who stated that I signed a contract and had to pay. So they reversed the credit. I had the policy for about 15 minutes before I canceled as they lied and had said my dentist was on the plan! I called Quick Health again for my refund but they said now that there was a dispute on my account, they could not issue a refund for 90 days. I needed that money! In May I called again to get the refund. Again on June 28 I called and explained that I need that refund. **** said to send her proof via email that the dispute had been closed and then she would try to expedite it. Wouldn't they have information on the processed payment? It has been a nightmare trying to get my refund. They are a sketchy company and I advise everyone to stay far away! I still have yet received my refund!

    Total scam artists and thieves at every level of customer service. The ********************** covered nothing, I experienced. The company withdraws your payment months before its due from your account, even after you say no, call to complain, so you must file a dispute claim. My bank said they have disputes filed regularly for the same reasons against this company and my bank is small town. It was a horrible experience to go through and pay for it! Buyer beware, this company needs to be held accountable for stealing from and harming people that need insurance and pay for it.
