7-1-23 gave D&M Transportation& Manufacturing Homes LLC a certified check # ****** for $4000 to install footers fo mobile home at address *** ***** **** ********** *** *****. He should have called 811 for excavating. That's his responsibility. Didnt do it. On 7-6-23 ask if he called 811. No response. On 7-11-23, I had to called 811 for my location. D&M said he would dig and pour footers on 7-18-23, 10am. He was a no-show. I called Unity Township, asked if footer inspection application had been submitted. Builder inspector ***** ******* said no. D&M had no intentions of doing the work, you can't pour footers unless you fill out an application, ***** inspects them. That's deceitful on D&Ms part. Told him on 7-18-23 I wanted my $4000 Deposit returned. He says if I breach the contract he would fine my $1000. It said nothing in the contract about and fines if I wish to get another contractor. I called an attorney on 7-20-2023. They said if agreement doesn't say anything about a fine, he cannot withhold any money. I told D&M that. He said he would issue me a $4000 refund minus administration fees (approx $250 ,average rate). On 7-20-23 , 9:34 pm I asked for a processing time for delivery method for my refund. He ask me for my mailing address. On 7-24-23 I ask him again a timeline for receiving my refund. No Response. On 7-25 23 I texted him and told him I was going to the Magistrate on 7-28-23 and the BBB if $4000 wasn't refunded 7-28-23. He responds by saying he will only give me $1250. Proceeds to make up a story of paying concrete ($2750) for the job and I would not receive that money for 30 days. That is a lie. You DO NOT pay for concrete until the day of the pour. I called the local concrete companies to confirm that. Told him I going to magistrate, he threatens me saying he is calling Unity Township to revoke my building permit. I can change contactors if I want.. I want my $4000 refund in order to secure a new contractor to complete my move.Initial Complaint

august 6th 2021 paid 10,000.00$ cash outta my husbands ira account to D&M Transporting for a 1997 14x76 mobile home included delivery , cement footers and set up on our property . paid for permits and site preparation as they came and looked at our site and told us what to do , and we did we have asked and begged and they refuse to set up our home or transfer the title to us or refund us its been almost ayear and we have alot of text messages back and forth of promising a move evry month for 8 months now and then they promised a refund and when we called and asked we were told out 10 grand was chump change they spent on disney and good luck with trying to sue as they have fayette county courthouse in their back pocket! we are about to be homeless and they laugh please help us and help stop these impsters from scamming more ppls life savingsBusiness response

D&M Transporting consisted of two owners during the transaction / sale of this home. Client: **** ******* was instructed that the home had just arrived at our storage lot and paperwork was not processed completely in order to transfer home ownership / sale. She was informed as many other interested parties were informed that titling could take some time and the home could not be moved or exchanged until all appropriate paperwork was completed. Ryan and spouse were instructed a deposit could be taken in order to remove home from advertisement. They decided to pay full amount. A site assessment was performed on location in December. The property needed some prep work for the home to be transported and setup on location. Unfortunately, the client did not take the appropriate steps to prepare the location. The comments listed in the statement from client are untruthful and disrespectful inflicting defamation of character on owners. I would love to take my family to Disney unfortunately, that is not and hasn't been in our budget. I am baffled that the BBB would even allow such a comment to be written. I have all the information needed to prove my statements and some are listed in attachments.
When the location was deemed unfit for the home, we notified the client that a refund will be processed as we are simply attempting to re-sale the home per request from and for the client. This is an action we are not required to do but was simply trying to assist the client with the unfortunate situation. However, this process takes time in today's economy for customers to come up with funds. Once the funds are secured a refund was going to be mailed to client: **** *******. Storage fees associated with the home can be applied to purchase as the delay was not inflicted by D&M Transporting and Manufactured Homes LLC. We will now need to utilize legal resources to process refund payment in which will simply delay refund to client even longer to ensure clients statements are removed from all platforms including but not limited to online social platforms.
