      Berkshire Hathaway is refusing to give my security deposit back, had to move from house because section 8 failed inspections because they wouldnt fix the issue of flooding in the basement causing mold

      My girlfriend and I moved into the an apartment in ******* and have been having wasp issues. We realized that they are attracted to the vines that have overtaken the rear exterior wall of the building. My family is allergic to bees and I am unsure if I am. My family won't even visit due to the wasps. I am looking into getting pest control to come as I am responsible according to my lease. Although, with the wasps being attracted to the vines, any efforts to eliminate one pest could easily bring in another unless the vines are removed. The lease signed by berkshire, my girlfriend, and I states that we pay 90 dollars to include landscaping done by the company. I have contacted them twice through the tenant portal and multiple times through email directly to the landlord over a span of 2 weeks but keep getting ignored. The wasp problem is worsening and we need the vines removed and expect the company to handle the landscaping as agreed and are paying them to do so before the issue gets worse or more pests come in.

      The transaction occurred on July 31, 2023. This was a real estate sale in which the **** Estate agent failed to do a final walk through of the property because he had gone on vacation. He closed on the property without my knowledge and the seller trashed the property and left all belongings behind. That I had to pay over $5,000.00 to remove all trash and sellers belongings. Berkshire Hathaway failed to acknowledge what happened and offered zero assistance regarding matter and were deceitful during the transaction. I am seeking damages.

      This company took over the house I was renting last year in the middle of my lease. Once they took over, it went from bad to worse. It was probably my worse experience ever dealing with a property management company. First my primary contact Liz was rude, condescending and unprofessional, see the texts in the images as an example. They took weeks to attend to my maintenance requests. There were issues with the property when I moved in. See attached pics. I told Liz about it and when I moved out, I was responsible for fixing these problems or I wouldn't have gotten my security deposit. She NEVER addressed these issues yet was rude to me about fixing them when I moved out. After all that, worst of all, it has been 45 days and I still don't have my security deposit back.

      We rented this property on December 18th 2022, mainly because the house has a heated in-ground pool. We are paying $2000 monthly rent. We were told by the realtor, Greg P**********, that all the pool maintenance will be take care by the landlord. After signed the lease, we mentioned he forgot to send the Pool Addendum, but we never received until June when the issues related to the pool started. Greg P********** sent us a completely false pool addendum saying what we didn’t agree on and he falsely signed our name’s without our consent! The pool was scheduled to be open on second week of May and was open on May 25th. The pool guy took off the pool cover and left without cleaning the pool. The pool was open and dirty until finally, someone came on June 8 and explained how to clean the pool. We spent hundreds of dollars trying to figure out how to clean the pool ( even when was not our responsibility to buy any chemicals )and again we requested maintenance, on June 20th he sent another guy because the pool wasn’t as clean as should be. After my husband figured out how to keep the pool clean, On July 3rd the pool heater stopped working. Since July 3rd until now we haven't been able to use the Jacuzzi and the pool for long hours because the heat is not working. They keep saying they are sending someone and they are going to fix the problem but it’s been months dealing with the same issues. After so many attempts to try to resolve the situation, we are still waiting for them to fix things.

      My name is ****** ** ***** *** **** ****** ***** we are in to buy property at *** ******** *** ********** ** ***** on Saturday Jan 21, 2023. CONCERNS---Berkshire/Hathaway selling Agent Carl M*****r , Punxsutawney Pa office. Was sick while inside this home. My job as the buy was to rewire every outlet, my ******* called my home the morning of Sunday Jan22 to tell us he tested positive for covid. Now my wife and I are sick! I would hope that the property is disinfected prior to anyone entering in future. And an apology to my wife..

      Return of earnest money. I alerted the realtor before the check arrived I would no longer be interested in the property due to the issues related to the inspection report. The check was cashed anyway. I am still waiting for the return of the earnest money. I contacted the brokerage firm and they did not call back as stated to follow up.

      I entered into a contract with BHHS on 9/15/21, allowing the to manage my home property at 304 ******** **** ********** ** *****. I have a tenant occupying my home that has chosen not to pay rent for the month of December. The Agent Denis T***** has allowed this to happen without giving me any knowledge of this agreement he made with the tenant. Tenant is responsible for paying $1200 for rent and $500 for her two cats.

      I just heard from Lauren J**** at Berkshire Hathaway  Home Service.

      Lauren, informed me that they want to pay from November  10, to the end of the month not stating an amount and not mentioning  for December's  rent.

      I informed her that it was not mentioned to me that having my stuff in my garage would  be an issue or grant giving the tenant pro rated rent. I also, informed  her that I to spend money to repair damage  to my front porch roof that was not reported  to me from Berkshire  who is supposed  to maintain my property.

      Lauren, stated that she will look into it further  and  get back to me.

      I received an email today of a payment from Berkshire Hathaway in the amount of $684.00, which is not a full payment of the amount of rent being charged to rent my home. The full monthly rent is $1200 a month plus for the tenants two cats $250 per cat.

       

      I know with the holidays things are taking a little longer to get resolved. They are cheating me out of my money per the contract agreement!

       

      I’m ready to move forward with an attorney.  Can you inform me if you have heard anything from them?

      The owner of the above referenced property entered into a residential lease agreement with the tenant. The tenant took possession of the property November 1, 2021. When the tenant moved into the property it was not in rent-ready condition and provided pictures to prove it. I previously urged the owner to clean the unit to a rent-ready condition. After the owner refused my recommendation of a professional cleaning service, she stated she would clean it herself. 


      On or about November 5, 2021, the tenant called to inform me that the owner was letting herself in the house and garage without permission. The owner still had many of her possessions in the house and garage. The tenant was unable to gain access to the garage because the owner had it locked. I texted the owner on November 8, 2021, and to my surprise, the owner stated she was keeping her possessions in the garage until November 10, 2021. The owner also stated that she would have her own cleaning company come on November 15, 2021, two weeks into the tenancy. The entire time during this two-week period, the owner would come and go unannounced. The tenant felt she had no privacy and stayed at a friend's house, which is unacceptable. The owner, by her own admission, didn't give the tenant possession until November 13, 2021. The owner did not abide by the lease contract nor the tenant's rights. The owner's statement that she did not receive a payment for December's rent is untrue, as the tenant only paid partial rent, based on the fact she did not have full possession of the property for the entire month. 


      Regarding the owner's statement about the cat, she is receiving a non-refundable pet deposit as stated in the lease. 
      In closing, as a gesture of goodwill, BHHS is going to remit the difference between what the tenant paid and what the owner feels she's owed.

      I have reviewed the response made by the business in reference to complaint ID ********* and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

      I disagree with the response from Denis T***** which is not the truth!

      First, issue of complaint was on Nov. 5, 2021, about a deep clean needing to be done. I received this in a text message from Denis T***** he asked if this was ok. I responded back and told him I will approve for the deep clean to be done. On Nov. 8, 2021, I texted Denis and let him know that I found a cleaning company to do the deep clean and to let the tenant know that we would be coming over for it to be done. Denis, asked me if I had keys. I said, yes I have keys and will be heading over to meet the cleaners. This was on Nov. 8, 2021.

      I get over there to the house around 3pm, I open the door and there is a cleaning company name ******* there and they were just starting to work. I asked the guy *****, I think is his name who called them to come here. *****, then responded to me that the owner called. I said, no I'm the owner and I didn't call you. *****, replied, yes, the owner named ********* (which is the tenant) called for us to come and clean. I said, I'm the owner of this house and I didn't call you and I just texted Denis and let him know that I had my own cleaning company to come and clean. He then, called his boss on the phone and I let the boss know that I did not call them for anything. The boss said, ma'am don't worry about it and advised his workers to pack up and that he would still pay them for that day.

      Then, I showed my cleaning ladies what to do they started working and was done in about 1 hour. While they were working I was in my garage organizing my things to get them ready to move out on Nov. 10th, 2021. On the 9th of Nov. I believe Denis texted me asking for the garage door opener. I told Denis, that I would be moving my stuff out of the garage on Nov. 10, and I will leave the garage door opener on the shelf. 

      November 10, comes I get to the garage in the morning around 10am, to load my stuff in the truck and to clean out the garage with the help of my cousin ***** Once the truck was loaded and the garage was cleaned we moved everything that needed to be out for the garbage because they were coming that Thursday morning. I put the garage door opener on the shelf as I stated in the text and locked the garage up and left. I have not been back to my home since November 8, and 10, to do the cleaning and move my stuff out.

      November 12th, 2021 I signed my lease at The **** ** **** ******* ****** ************* they will confirm that I was not in Pittsburgh on the `15th of November to enter into my house. 

      The only thing that I have mentioned regarding her cats is that the payment is $250 per cat.

      Well, I would not call that good will because, they did not discuss with me anything about prorating the rent which they did anyway without my knowledge or consent! I have not received full payment for December and I'm not so sure that I will receive the full payment for January. When I asked Susan (Broker) about the payment today on the phone all she stated was that it was sent to BHHS and they will send it to me. Also, letting me know that they will honor the termination of the contract!
