      On July 27, 2021, I called my Home Warranty Company (Cinch Home Services) and reported my refrigerator was not working and paid $125.00 for a service fee. I was assigned Apex TV & Appliance Service. They ordered parts on July 29, 2021, and received the parts on August 6. They then scheduled repairs for August 25, 2021. Brandon the repair technician arrived at my house at 2:00 PM on August 25. He slid my refrigerator front to work on the back but could not repair it. When he slid my refrigerator back I noticed he tore my vinyl flooring and showed him. I had an appointment and told him I had to leave. I went out to my car and Brandon came out with his telephone and handed it to me and told me to sign in the box. On August 26, I called Apex and asked if Brandon reported tearing my floor. They pulled his report and said I signed a Waiver of Liability at 2:38 PM. I denied signing any such thing. I have estimates for replacing my floor for $2,084.69.

      I am sorry that the customer feels this way. Before we uninstall any heavy appliance we advise the customer that even though we take extreme care and precautions, there is always the possibility of damage of some kind. This is why we have the customer sign a pre-work waiver of liability. The customer is also free to move the appliance themselves before technician arrives (which many customers do). The technician also noticed and pointed out other damage to the floor that was prexisting as well as the linoleum being aged and poorly glued to the subfloor. If we did not have this waiver, we would be remodeling people's houses. We only receive a small payment (under 150.00) to fix the appliance under home warranties. If it weren't for the waiver, we would not provide service at all.

      I am rejecting this response because:

      The floor was not torn and in bad condition before he moved the refrigerator.  I showed him the torn places after he pushed the refrigerator back.  He arrived at my house at 2:00 PM and he rushed to my car as I was getting in my car to go to another appointment.  He handed me his telephone and told me to sign in the blank box at 2:38 PM.  My floor was only 2 years old and I did not know I was suppose to move the refrigerator myself!  I was told by your company not to do anything.
