      We are a third party collection agency. This account was placed with us by our client, who has a contract with us. This debt is a for signing bonus received by this individual as an incenbtive for employment. This individual did not complete their terms and conditions of their signed contract with our client, hence this matter has been in our offices since March 9, 2022 for collections.

      I am not liable for this debt with Bilateral Credit, I do not have a contract with Bilateral Credit. Bilateral Credit has violated the ******** Consumer Finance Act (****). Prohibition of deceptive acts (Va. Code ***. 18.2-213) which prohibits debt collectors from using any type of simulated legal document in an effort to collect a debt.(see "legal document" PDF attached)

      Bilateral Credit is also not legally allowed to collect debt in the state of **. The **** states Consumer finance companies must be licensed by the state of ********, undergo a rigorous vetting process, and maintain compliance with the terms of the ****. 

      They have also violated Federal Debt Collection Practices Act (FDCPA) 805. Section (a3) - Communication in connection with debt collection and Section(b) Communication with third parties
      Except as provided in section 1692b of this title, without the prior consent of the consumer given directly to the debt collector, or the express permission of a court of competent jurisdiction, or as reasonably necessary to effectuate a postjudgment judicial remedy, a debt collector may not communicate, in connection with the collection of any debt, with any person other than the consumer, his attorney, a consumer reporting agency if otherwise permitted by law, the creditor, the attorney of the creditor, or the attorney of the debt collector. 
      By calling my place of employment to discuss this matter with the *** *******************************. (See phone screenshot attached)

      As originally stated in the first complaint I demand a correction to my Credit Report, that this account be removed from credit report, as I never provided any consent nor written correspondence to place on the credit report.

      This is not considered a personal debt as defined by the Fair Debt Collections Practices Act. This is a payroll overpayment that is identified as a labor debt, under commercial rules and regulations. We have attached this individuals job offer showing the contractual obligations, the overpayment letter from our client informing them of the balabce owed and time frame to resolve, the payroll calculations from our client identifying the overpayment as well as our letter of authority to act on behalf of our client. This account was placed for collections on or about March 9, 2022. We have attempted to reach this individual through **** and telephone messages. This individual has not once contacted our company directly to resolve this matter. This is a current and valid debt owed to our client and does not fall under the ******

      I am not liable for this debt with Bilateral Credit, I do not have a contract with Bilateral Credit, the company did not provide me with any original alleged contract as I requested.

      Bilateral Credit has not provided any original alleged contract. Bilateral credit has provided a document Authorized Letter that post dates the account on the consumer credit report. The Authorization Letter is dated January 2023 and Bilateral Credit opened a collection account on the consumer report in March 2022. 

      Therefore I expect a correction to credit report, and demand this account be removed from credit report.

      On 11/22/23, I was contacted by *************************** of Bilateral Credit. This was in regards to a debt to 4imprint, a printing/collateral production company. ****************** misrepresented the relationship between Bilateral Credit and 4imprint and used demeaning language throughout the interaction.Specifically, ****************** told me that what I said was "Crap" and that he's used to dealing with "People like me". Additionally, when I mentioned that the debt was not mine personally and that I would reach out to 4imprint directly to sort things out, he said that 4imprint would not speak to me about this debt because he was their legal representative in this matter. He then went on to say that he would intentionally ensure that this debit would be reported to my credit report "Today". He then hung up the phone. I reached out to 4imprint and communicated with their Sr. ** of Finance, ********************* who advised me that they have directed Bilateral Credit to always reach out to 4imprint directly to resolve these matters. ************ has indicated that he will be taking action as a result of this deviation from their standards.I have reached out to the listed owner, *************************** but have not received a response.

      I have not heard from the business in response to my complaint. I have also attempted to reach out to the owner via direct message on LinkedIn. He has not responded to my message there either.

      At no time did ********************* speak to this individual in any manner than professional. We attempted to reach thbis indivual for approximately four weeks. When we did finally reach the debtor, he was argumentative and combative and then paid the debt in full.

      I cannot imagine that anyone who listened to the recording of the call would consider ********************* as Professional.  *****************:

      - Told me that what I had to say was ****.

      - Yelled at me that he was seeing to it personally that the debt in question would be reported to my personal credit file that same day. He then hung up the call.

      - Told me that 4imprint would refuse to speak to me about this matter. This was a lie. I confirmed with the *** of finance at 4imprint that they encourage Bilateral Credit to advise clients to reach out to 4imprint directly. 

      - Refused to allow me to speak at several points in the call, continuously speaking over me.

      If the person responding to this complaint views any of the above as Professional, then I must conclude that they do not understand the word.

      As for the attempts to reach me for four weeks, there was one single voicemail left on my phone days before I spoke with ******************. The only correspondence that was delivered by mail arrived only after our conversation.

      Furthermore, the debt was paid in full only because ****************** threatened to report it to my credit that same day and refused to allow me to sort this matter out with the party that actually placed the order.

      We hereby stand by our response as in no way did our representatives ever conduct themselves in any manner other than professional.

      Our clients, once an account is placed for collections, will refer their debtors back to Bilateral for resolution of that debt. 

      This account was placed for collections with our office on or about October 31, 2023 and the account was, in fact, scheduled to be reported to the credit reporting agencies.

      Our client had attempted to reach this debtor for months prior to placing it for legal collections.

      Our records indicate that when speaking with this debtor on November 22, 2023, the debtor was quite argumentative and refused to cooperate. Our representative did, indeed, termintae the call. The debtor then called back approximately eight (8) minutes later and presented his credit card to pay the balance in full.

      Bilaterals response addressed none of the issues that were outlined in my complaint and I do not accept ******* behavior as professional in any context.

      Furthermore, I did not call back 8 minutes after ********************* up the call. I called back immediately and asked ****** to connect me to a manager, to which he refused. Once again, I only made a payment because of the threats that ****** made regarding making it his personal business to report this to my credit that same day. 

       If Bilateral refuses hold themselves or their employees accountable, then I will exhaust every avenue available to ensure that this demeaning and disrespectful behavior is addressed. Its absurd to believe that it is Bilaterals CEO ****************** finds it acceptable to treat anyone with such disrespect. 

      There are several reviews and complaints posted online concerning demeaning behavior by Bilateral Credit (Specifically naming ******). 

      In addition to the BBB, I will be opening complaints with the ********** of ********* Services and the State Attorney Generals office.
