      I was in a car accident and paid the law firm to represent my case. They referred me to progressive insurance and they are not willing to assist with closing my case. It all started with *********,with progressive. I received several calls asking who has my keys and car when in reality different agents with progressive had these items. The claim agent ******************** has been unprofessional the entire existence. I have all emails to confirm, sent to progressive and the law firm. Progressive is refusing to pay me my final settlement and not providing any further assistance and the law firm said theyre not representing me after receiving payment in full. How do I close this case and receive my payment? This process is causing me anxiety and trauma because no one is willing to help. Im only asking for whats owed and theyre all refusing. If necessary I will submit a civil complaint because this case has been ongoing for almost a year.

      The Bottaro Law Firm represented ********************* for her bodily injuries sustained in a vehicle crash that occurred on September 4, 2023.  We represented her for her injury claim only, and not her property damage ("PD") claim.  Our paralegal and attorney on *****'s file initially helped ***** in ascertaining the PD adjuster's contact information. The PD adjuster, ******** at ****************************** was apparently frequently unresponsive. On several occasions, our attorney and paralegal reached out to set up conversations between ***** and the PD adjuster ******** when ***** informed us that ******** was being unresponsive.  This is not part of our fee agreement or her bodily injury case, rather our paralegal and attorney were simply attempting to help our client ***** through the difficult time she was having with the separate PD aspect of her claim.  At no point during her bodily injury case did we state to ***** that we were representing her for the PD portion of her claim, and it's not noted in the fee agreement (see attached).

      Regarding *****'s bodily injury claim, we were able to reach a settlement on behalf of ****** which she signed a release for on December 19, 2023. Her bodily injury claim funds were disbursed on January 4, 2024 via certified mail and our file was closed. 

      From *****'s complaint, it appears that her PD claim remains open with Progressive Insurance.  This is possible as the bodily injury claim we represented her for that has since closed is an entirely separate claim from the PD claim.  As we never represented her for this claim and merely assisted her with getting in contact with the PD adjuster during our representation for her bodily injury claim, it appears this complaint would be misdirected as we are not in a position to resolve this for her.

      ***** also noted in her complaint that we referred her to Progressive.  Progressive simply happened to be the other driver's insurance policy, and was in no way referred by our firm.

      It would appear that *****'s complaint is with Progressive due to their lack of responsiveness in resolving her open PD claim for her vehicle if she has not yet been paid for the damage from this crash.  As for the bodily injury claim we represented her for, that portion is closed and resolved.
