      On 11/3/2023, our repossession agent picked up the vehicle that secured this loan at the property **************************************************************************************. This is the same address as in the complaint. The keys were turned into the agent 11/3/2023 and the debtor retrieved their personal belongings. The debtor disputed the debt in April 2024 through the credit bureau agencies claiming ID Fraud but they have not submitted the *** ID Theft Report nor has he submitted a police report. We have asked the debtor for a copy of either report. We have not received anything. The debtor did submit a copy of a CFPB complaint screenshot, but it does not have any information other than the fact he filed a complaint with the ***** He also submitted a document called Affidavit of Truth.

      Greenwood Credit Union has researched this customer's complaint and determined that the account(s) related to the customer refer to an auto loan that was repossessed for non-payment. Information was sent to the address on record at the credit union prior to and throughout the repossession process. The address on record matches the information the customer provided in the complaint and the credit union has no reasons to believe the customer did not receive these communications. There had been no mention until recently of identity theft or other fraud by the customer until now, at which point the ********************************************* requested a police report which was not provided.  The customer provided an "affidavit of truth" a document that the credit union is unfamiliar with and is not the required police report.  The customer will have complete a police report and provide a copy to the credit union to initiate the resolution of their concerns. In addition, the customer will also have to dispute the reported matters with the credit bureaus.

      The credit union will be contacting the customer to request to provide a copy of the police report relating to this incident. The account has been reviewed by our institution and found that loan payments were received routinely which is uncommon in cases of identity theft;fraudsters will not repay a loan.  This resulted in no identity theft indications. The customer will be contacted and the situation discussed to find a resolution. The customer may have to directed her concerns to the credit agencies and request the update or correct any incorrect information on her report(s).

      Details: Fees: $392.76 Transactions has been happening all month, they kept hitting me with a fee knowing my car insurance were working on getting the appraisal money to them. The nature of my dispute is the lack of communication Ive been dealing with this credit union and how unprofessional this manager is on how he hasnt been returning my calls and Im just consistently getting hit with fees. My car was a total loss at which I wasnt at fault and my insurance had to get my car appraised and I made the credit union aware of what was going on as well as my insurance. So Im just trying to get some accommodations made but Ive been trying to communicate with the manager for over a week now but he either leaves early or doesnt return my call and let another day go by. I dont mind paying the balance without the fees which should be 1 months worth of premium but I feel like Ive been scammed because even when I would call and ask if they received the check I was told no and so I reached out to my insurance and had them put a stop pay and overnight a check but then was told they had the check all along but it was too late since it was already stopped so I feel like Im getting hit with unnecessary fees too when they had the check. *** left voicemails, emailed and called and Im not getting any response.

      Upon receipt of the complaint, the appropriate business unit managers were informed and the matter was researched.  We were able to determine that our credit union received and applied the pay-off check to the loan on or about February 15, 2024. Loan operations personnel contacted the borrower to explain that after applying the check to the loan balance, a deficiency remained and put the borrower in touch with out collections department. Our department was able to obtain a refund on the extended warranty and apply that to the balance of the loan. This satisfied the outstanding balance and created a surplus that was sent to the borrower this past week.

      The borrowers complained that the credit union should stop accruing interest on the loan and charging late fees. It was explained to the borrower last week that is not possible to do this since the credit union does not know when the loan will be paid off, therefore interest will continue to accrue; it may be a long time before the credit union receives the payout from insurance and we have no way to control the process. The loan remains outstanding until the payment is received.  There appears to be some discrepancy with the receipt of the payoff leading to stops being placed on checks and new checks issued.  This will be researched by the credit union to determine the root cause of these issues. 

      It is the credit union's intention to refund the borrower six days' interest that accrued between when check was received and applied.  A member of the credit union's senior management team will contact the member to discuss this plan and hope that it will satisfy her complaint.

      Greenwood Credit Union has reviewed this complaint as well as the customers history with the credit union.  The customer does not have a ********************** card with the credit union and no collections activity has taken place. The customer had contacted the ********************************************* regarding an existing loan and all questions relating to that loan were answered at the time.  If the customer has any further questions or concerns, we encourage the customer to contact the ********************************************* and we will be happy to address any pending matters.

      I took out a car loan from them for my daughter and son in law. My son in law missed numerous payments but I always caught them up and even paid more. The car was sold off to ******************* in ************ in September . Greenwood does not have the title to the car anymore, but September 30th stated I still owed on the car. ******************* has the proof they cashed the payoff check. They went and spoke directly to them. I just received an e-mail from Experian with a delinquent notice from Greenwood Trust dated November 3, 2022. This is now affecting my credit rating. I am expecting Greenwood Trust to make this right to reflect there was no delinquent account and a huge apology. If there is a way to *** them, I am for it!

      The credit union has reviewed this customers complaint including the loan payment history, communications with the customer(s) and the pay-off from *******************.  Tis included reviewing an image of the check submitted for loan payoff and the processing time of that check.

      Based on the customers statement in the complaint and the information obtained, it appears that the vehicle was sold to ******************* in September but the dealership did not pay the credit union for the vehicle until October.  The check was promptly processed and applied upon receipt by the credit union. The credit union was not informed of the sale and had not received payment on the loan and therefore the loan payments were considered late. The credit union tried to communicate with the customer via phone, e-mail and postal mail with no response resulting on the loan data being reported to the credit agencies.  Once payoff was received, the loan was considered paid.

      Based on our review, the underlying issue is between the customer who sold the vehicle and the dealership that did not pay off the loan in a timely manner. We would suggest that the customer contact the dealership for clarification on the delay of payment of the vehicle.

      I received a loan from greenwood credit Union and I was trying to get direct deposit but somebody that worked there told me I couldn't get direct deposit online so then the wound up they put on my credit report a missed payment when the other lady that I talked to after they put down as a missed payment showed me a way to go online and do it and it took me literally less than 3 minutes to take care of the problem what should have been solved to begin with from the idiots working at greenwood credit Union and so now it's somehow it's my fault that I have the Miss payment on there and not theirs and now I'm supposed to dispute it with the credit bureau and then have them look at it because it's a s**** up from greenwood credit Union and they don't want to take care of it because it makes it look makes them look bad well greenwood credit Union you're a terrible company you're horrible business to do any work with you guys should be ashamed of yourselves

      The credit union has researched the customers complaint and determined the following: 
      The customer contacted the ********************************************* on August 17th,2022 to request a direct deposit of a payment for their loan.  The customer was informed that it is not possible for set-up a direct deposit online but was provided a form to complete along with the required information that would allow the customer to establish automatic payments to be made electronically on the loan. The credit union also processed a phone payment for the customer.  The customer never retuned the automatic payment form and was contacted by the credit union again when their payment later became past-due. The customer explained that they thought they had established automatic payment instructions, acknowledged that no payment had been sent and promised to pay the following day.  The customer failed to make a payment as promised and only contacted the credit union once his delinquency was reported.  The collections department provided the member with information on how to dispute the reported delinquency but the customer stated that he did not like the idea of disputing the report and ended his call with the credit unions representative.  The customer is free to contact the ********************************************* for further information or assistance but the credit union considers this response to the complaint complete.

The customer remains current on the loan, has expressed his intention to pay per the loan agreement and does not dispute the credit unions service to the customer.  This complaint may be filed against the credit union by mistake or by a third party using the customers name.

      Greenwood Credit Union has researched the issues presented in this customers complaint. Our records indicate that the Credit Union has been in contact with this customer on various occasions to assist with account issues, inquiries, facilitating payment arrangements, etc.  Despite having made payments on the loan over the course of several years, the customer has now claimed to be a victim of identity theft.


      The Credit Union reviewed the  customers loan application and supporting documents and found there were no identity theft flags on the  customers credit report,. In fact,supporting documents bear a photo that appears to match the customer and the documents bear signatures that appear to match.  These findings, combined with the history of the customer making payment on the loan over several years,are inconsistent with a case of identity theft.  The Credit Union will be communicating directly with the customer to discuss alternatives to resolve this loan.

      Greenwood credit union contacted this customer to review, discuss and resolve the concerns expressed to the BBB.  It was determined that the member had been working with the credit union for a loan modification which resulted in changes to the interest and principal breakdown of payments following the deferment.  This is a simple interest loan where the interest is calculated on the current principal balance on a daily basis. The credit union offered to provide a report detailing the impact of the changes he requested but the member declined stating they understood the changes and detailed reporting was unnecessary.
