      I dropped my 1974 VW Super Beetle off at the shop on November 1, 2022 to be diagnosed for a running issue. After several back and forth discussions with the owner Mark Myers, we decided that an engine rebuild would be the best option. I paid him a $2000 deposit that was to be used for purchasing a rebuild kit. The kit was purchased in February. It took a long time for the kit to come in ( supposedly due to parts shortages from Covid, etc.) April 11 I asked about the status of the car. Mark replied that the kit had come in but he had major issues with his shop, had to move to a different location, etc. but it had been started on. From April to August, communication became more and more spotty and ultimately non-existent. I finally got fed up and stopped by the shop unannounced to see what was going on. Only a couple parts were removed from the engine and it was just sitting outside. I was shocked and furious by what I saw. When the car was dropped off, it was in pristine condition and I have a photo of it taken the day it was dropped off. I instructed Mark to put a cover on it (which was in the trunk) if it ever needed to be left outside. When I stopped by the shop the car was in deplorable condition from sitting outside for almost a year uncovered. I told Mark I wanted my deposit back and that I wanted to tow the car out. I suggested that he have it detailed as well. I got a song and dance about having to return the rebuild kit before he could refund my money. After numerous calls, texts, and messages requesting the refund, I have heard nothing. He will not respond to anything. All I want is my $2000 back and my car returned in the condition it was dropped off in. I have records of all communication that will show the total lack of concern and professionalism from this business.

      On 10/14/22 my transmission failed in Columbia SC enroute to Tampa Fla. I paid Myers Motorworks total of $6,392.51 to repair. After a week and a half in a hotel ($1000) van was repaired with warranty on transmission. On 1/13/23 replacement transmission failed. 1/23/23 Shipped van back to Myers to cover warranty ($643.88). 1/19/23 -2/19/23 Had to rent Uhaul van to keep working my job while staying in hotel. ($2023). 2/10/23 Myers texted me new transmission was in and will be installed on 2/13/23. 2/16/23 reached out for a update got no response. 2/21/23 I sent my Dad my the shop to get a update he reports by to me that the shop was shut down van inside up on rack. 2/21/23 contacted Columbia South Carolina code enforcement to be informed that the shop didn't have a business license for 9 months. Well before receiving my van. Still no response from Myers forcing me to return home by way of rental car because I couldn't afford rentals for work. Job gave me a loan to keep renting so I returned back to New Hampshire for work. 5/22/23 Myers Motorworks finally called and claimed the van was ready but there was a problem he think with the flywheel and he can drop the transmission again to check but it would cost knowing he damaged the flywheel when he work on the transmission. I explained to him that I had total hip replacement surgery and that's why I wanted the van sooner when he wasn't answering his phone. He then texted me on 7/26/23 to ask my plans for the van because I had several months of storage fees. I told him I was enroute to pick up van but I shouldn't have to pay no storage fees because the van wasn't fixed and he was missing when I was trying to get van before surgery. His reply was then I'm placing a lien on it. All I wanted was my van I was prepared to have someone else look at the flywheel and add to my lost but I don't feel like I should be paying storage fees. If anything he should return all my money because he wasn't technically open for business.

      Mr ********* was advised every step of the way about the status of his warranty repair. We ordered a replacement transmission, under warranty, with the company who supplied the part, and installed the replacement part at no additional labor cost to him, per Myers MotorWorks warranty. The transmission replacement was completed in April and Mr ********* was notified. He was also notified the vehicle has an issue with the engine, not the Flywheel as Mr ********* claims in his complaint, but it is completely unrelated to the transmission issue we were tasked with, and would need diagnostic done on the engine at additional costs. Mr ********* declined.  Mr ********* advised he was not in the area, had recent medical issues, and would have to let us know when he could make arrangements to come back to South Carolina to pick it up. Our company policy is for customers to pick up their vehicles within 3 days of completion, or accrue storage fees at a rate of $45/day, as stated on our invoice. We pride ourselves on being customer focused and temporarily waived those storage fees for Mr ********* due to his medical issues he had explained to us. After not hearing from Mr Whitter for a few weeks, we contacted him again on 5/26 and asked for an update on when he could get his vehicle, as it was taking up space in our lot and we needed the room for other customers. He advised he would come get the vehicle after the Memorial Day weekend. Once again, we didn't hear back from Mr ********* for 2 months when we reached out to him in July to ask him when he was coming to get the vehicle and advised him he would have to pay storage fees before the vehicle would be released to him since it has sat in our lot since April and it was now over 3 months later with no contact from him. He stated he would be coming to get the vehicle but he was not going to pay for any storage fees. We advised him we would have to put a lien on the vehicle if he refused to pay the storage fees. He never showed up, and we haven't heard back from him to this day.

      Our business license was never revoked. We were temporarily closed, during the month of March 2023, while relocating to a new facility, as our previous landlord at 325 Veterans Rd decided to break his 3 year lease with us to acquire a more lucrative investment in his building space. The landlord rented the space to us knowing it was not zoned for an auto repair shop, At no time were we forced to shut down and cease operations by any legal entity. We were in communication with the code enforcement division and they advised us to continue doing business as usual while they were working on rezoning that area at that time. We had to close down temporarily to move to our new shop location at 751 Greenlawn Dr, and have all vehicles and equipment moved or towed, at our expense, to the new location. Once we had all equipment installed and in operating condition at the new location, the beginning of April, Mr *********'s vehicle was one of the first to be finished.

      Mr ********* was advised that the first transmission we installed was damaged due to a problem with his engine, which he declined to have diagnosed or worked on and even claimed he was going to contact his finance company about the vehicle and possibly have them retrieve the vehicle.  After completion of the warranty swap for the second transmission, Mr ********* failed to reach back out to us to check on his vehicle or update us on when he was coming to get it for several months, and only communicated with us when we would call him to request an update, and every time he told us he was making arraignments to come get it.

      At no point in time has Mr ********* shared any concern about the status of our license or the zoning codes of the building we were occupying during the time his vehicle was being worked on, nor any time after completion. He never requested any type of refund, or reimbursement, and never expressed any issue in regards to our business practice or being unsatisfied with the work we completed. We believe the only reason he is filing this complaint now is because he has failed to find a solution of getting back to South Carolina to retrieve his vehicle after several months of no communication from him, and now does not want to pay the storage fees he has accrued. This issue is not about zoning codes or business licenses.

      At Myers MotorWorks we pride ourselves on customer satisfaction and go above and beyond to make sure we maintain our reputation. We are always willing to work with our customers and find a solution to their needs, within our scope of practice, as we don't want anyone leaving here unhappy or unsure about their vehicle's repairs. Had Mr ********* expressed any concerns to us at any time, we would have been more than willing to work with him to find a solution. At this point, his vehicle has been stored on our lot for 4 months and we believe we are justified in expecting compensation for that storage. We are still willing to work with Mr ********* on the storage fees if he is willing to make arrangements to have the vehicle picked up and removed from our lot.

      The Department of Labor, Licensing. and Regulation is having me contact The Department of Consumer Affairs for what I need as far as the timeframe the business was down due to code enforcement issues. I have spent a lot of money with Meyers Motorworks. And was not told of any fees storage fees nor is it on any paperwork given to me until July 26th in a text. The only solution I see is them releasing the van to me misses any fees. And if I have to pay fees from July 26th until I filed this claim then I want to be reimbursed for expenses due to the time he was down for code violations and/or moving none of which is my problem while I am accruing expenses because of their delays.
