    On December 03, 2019, Vision Property Management, LLC, Kaja Holdings 2, LLC, RVFM 11 Series, LLC, DSV SPV 1, LLC, DSV SPV 2, LLC DSV SPV 3, LLC, Alan Investments III, LLC, Boom SC, LLC, Yora, LLC, RVFM 4 Series, LLC, RVFM 13 Series, LLC and Alex Szkaradek (collectively "Defendants") and the People of the State of New York and Financial Services of the State of New York (collectively "Plaintiffs") entered into a Consent and Stipulation under Case Number 19-CV-7191 (JSR (OTW).

    The Defendants entered into the Consent and Stipulation consenting to the entry of a Final Judgment to resolve the civil litigation against them. The Defendants agree not to take any action or make any statement denying, directly or indirectly, the propriety of the Final Judgment by expressing the view that the Final Judgment or its substance are without factual basis. Nothing in this Consent and Stipulation or Final Judgment affects Defendants': (a) testimonial obligations; or (b) right to take legal or factual positions in connection with litigation, administrative claims, investigations, or other legal proceedings, and/or to deny allegations made by parties in other litigation, administrative claims, investigations, or legal proceedings to which neither of the Plaintiffs is a party.

    The Stipulation Order and Final Judgment states the following:

    1. Defendants shall not engage in acts, practices or conduct that violates the following laws and regulations: The Consumer Financial Protection Act 12 U.S.C. section 1601 et seq; New York Executive Law section 63(12); New York General Business Law ("GBL") section 349; New York Banking Law Article 12-D; New York Banking Law sections 6-l and 6-m; 3 CRR-NY sections 41.3(a) and 41.4(a); 3 CRR-NY section 420.18; New York Financial Services Law section 408; Truth in Lending Act, 15 U.S.C. section 1601 et seq and Regulation Z, 12 C.F.R. section 1026 et seq; and New York Real Property Law section 235-b.

    2. Defendants are permanently restrained and enjoined from engaging in the following activities in New York:
    a. Purchasing, selling, managing or leasing any Residential Real Property except as expressly provided for in this Final Judgment or for their own personal use and enjoyment;
    b. Assisting Others in purchasing, selling, managing or leasing any Residential Real Property except as expressly provided for in this Final Judgment;
    c. Providing any form of financing for the purchase or sale of Residential Real Property
    d. Assisting others in the financing of any purchase or sale of Residential Real Property;
    e. Advertising, marketing, or promoting, except as expressly provided for in this Judgment, the purchase, sale or lease of any Residential Real Property or the financing of the purchase or sale of any Residential Real Property;
    f. Assisting Others in the advertising, marketing, or promoting the purchase, sale or lease of any residential real property or the financing of the purchase or sale of any Residential Real Property;
    g. Servicing, collecting, attempting to collect, assigning any right to collect payment from any Consumer relating to a Residential Property Agreement; and
    h. Taking any action to evict or foreclose on any Consumer occupying a Residential Real Property or suggesting, requesting or pressuring any Consumer occupying a Residential Real Property to give up his or her rights to or residency at a Residential Real Property.
    3. All injunctive relief contained herein applies to any legal Entity that Defendant Szkaradek currently controls or has an ownership interest in or any legal Entity that Defendant Szkaradek obtains an ownership interest in or control of in the future.

    As of January 14, 2010, the Stipulation Order and Final Judgment has not been signed by the Honorable Jed S. Rakoff, United States District Court Judge.

    Better Business Bureau (BBB) is informing consumers and businesses about the marketplace conduct and complaint history of Vision Property Management, LLC, a company that is a real estate investment company.

    BBB believes Vision Property Management, LLC may also be using the business names of 10Talents, LLC, Kaja Holdings, US Home Rentals and Vision and Boom, LLC.


    BBB noticed a pattern of issues concerning:
    1. CUSTOMER SERVICE ISSUES: Consumer receive no call back or return emails; and
    2. CONTRACT ISSUES: Consumers sign a contract for rent to own where Vision Property Management breaches the contract due to non-payment of taxes, not reimbursing consumers for repair work and the property being sold without consumers knowledge.

    On January 19, 2022, Vision Property Management, LLC was informed of this concern and invited to discuss the pattern of complaints and determine ways in which the pattern might be alleviated. Vision Property Management, LLC has failed to respond to consumer complaints and BBB Serving Central SC and Charleston's correspondence.

    As of February 01, 2022, Vision Property Management, LLC continues to have unresolved complaints and remains invited to contact BBB to discuss the concerns of their consumers concerns.

    While BBB continues to accept and report complaints against this business and fulfill its responsibility to inform businesses of communications from its customers, this business has stopped responding to BBB. Therefore, as of February 01, 2022, BBB will close all complaints as unpursuable. However, should the business respond, consumers will be notified.

      I signed a 1 yr lease on a home in mid may we complained of a wet dark carpet stain which was glossed over. In early July we noticed black stains coming through the downstairs sheet rock from upstairs bathroom that was never used. They sent 2 bids through who both told us it was black mold and it was bad. The owner or property manager would not disclose the assessment. We then paid 2400$ for our own assessment from a professional microbiology team. Their 10 plus detailed report stated it was the most severe and extensive case of mold and deemed it “uninhabitable “. We moved into a hotel immediately and sought medical attention the results of which concluded that mold was the culprit behind our symptoms. I asked for deposit back and month of July rent back for the inconvenience. I also asked them to await our renters insurance assessment and see what total loss on damaged possessions were. We spent 1400$ for treatment of the must haves in our home as it was all we could afford to treat. The total loss was 34000$. My renters insurance covered 4000$ for meals and hotel and 6000$ toward our loss of 28000$. I texted the vision property management person directly whom told me all further conversation needed to take place via their website. They did agree to void my contract but continue to send notification of continuing to withdrawal 2900$ of monthly rent. I’ve asked them to stop but I don’t get a reply. I’m left hanging.       Leased a rent to own home in 2019, did major repairs to the home, over 30,000 dollars worth, they still charged us 900 per month for the home. Then the house still was not in livable shape and we moved somewhere safer, but I need to know if we can get our money back from what we put into the property.
