      I had engaged PMC Land L&T LLC of Easley SC and especially Pedro ****** C*** in early June to do work on my yard so as to divert water that would enter my house on occasion during heavy rainstorms (live on a hill). We agreed he would take down one large tree and build up the hill area so as to divert the water away from my house. I tried to get him out to the house before I left the country for 9 weeks but he kept changing the date. We finally agreed he would do it while I was gone and my house sitter would pay him. The day of he was to do it he said he would need to remove some more shrubs and some of the grass would be destroyed. He removed all the shrubs in the area and a large swath of grass was destroyed which I saw the full damage of after I returned. Yes he sent me pics but I could not fully comprehend it. The real problem was not the yard damage but the case that he did not divert the water as it is going to the same place it was before. I asked him to come out and he said he would the next day but no showed. I then became more curt with my texts and email and he then decided he would not come out to the fix the problem. He then said it is not his fault if a couple of storms eroded what he did. But that is what I paid him to do to make sure the water would be diverted. He has refused to come out and rectify the situation saying that nobody complained until two months after it was done and it was no longer his problem, remember he knew I was out of the country for that period of time and it was only a month and half. I have also asked numerous times (text, call and email) for a receipt for the job which he has refused to send. Again he was paid to divert the water away form the house and to do so he would need to remove a big tree. While he definitely removed the tree the water is clearly not diverted. He needs to either do the job properly (though I would rather go with someone else) or reimburse me. I have plenty pics but the system would not allow upload

      From the initial visit to *** ******** St Greenville, SC 29607, Mr. ******* ******* wanted us to complete the job immediately. We informed Mr. ******* ******* that we would try to do it a week from when we talked but we were three weeks out in our schedule. He did mention he was going out of town but we did not know when or for how long. On the date the job was to be performed upon arrival we communicated with Mr. ******* ******* giving him notice that we’d have to remove some bushes and his lawn would be damaged but we would smooth it out before departing the property. We told Mr. ******* ******* if he did not want us to perform the job because of this it is fine and Mr. ******* ******* replied that he was ok with it and for us to go ahead with the job. We removed two bushes and the rest were weeds. We completed the job, diverted the water, and removed a tree and stump. Upon job completion detailed pictures were sent to Mr. ******* ******* via text of the job performed. We also did complimentary seeding and laying straw to the property and gave specific instructions to care for the seed to the person staying at the house at the time. We were not notified of how long Mr. ******* ******* would be gone which there is no need for us to know that. Mr. ******* ******* called us two months later that he was not happy with the job performed. We replied that it had been almost two months and we had several heavy thunderstorms and rain. Because of the time lapse that it took to notify us and there was no agreement to do any erosion control we are not responsible for any erosion. However, we offered to send our team to the property to re-seed and lay straw as a courtesy which he agreed to, but that same day Mr. ******* *******’s demeanor became aggressive and unprofessional. Therefore, this led us to believe it would be inappropriate to send our team back to the residence. In conclusion, since it was not included under our agreement for any erosion control, we feel it is not our responsibility to correct any weather related erosion nor refund Mr. ******* ******* for a job that was completed without any complaints from the person staying at the property or Mr. ******* *******.       I have read the response from PMC and completely disagree with their assessment of the events

      1.      They continued to delay the project without informing, it was my responsibility to find out and then would tell me they cant make it only after I called. This is/was a reoccurring theme throughout. At one point Pedro mentioned oh I forgot to hit send on the text.

      2.      As I mentioned they did not send me a scope or work nor a receipt for work which I asked for on multiple occasions.

      3.      They mentioned they would have to take down some of the bushes and some damage to the yard they did not say all of the bushes and extreme damage. As far as the reseeding unless you aerate the yard as it is red clay the seed will not take. This is very obvious.

      4.      I clearly told Pedro that I would be gone for two months when we met. After 1 ½ months after they finally did the job is when I returned is when I saw what was done. To his point of sending me photos yes that is correct but from what I saw via photos from him and my house watcher I could not fully see what was done. Though I was completely shocked at how much was taken out in that my idea of “some” and his was very different.  It was not until I returned did I see that he had not done the job which he was paid to do.

      5.      The water is going to the exact same place it was before. If in 1 ½ month his work is already ruined (as he said there was two big storms and he cant help that) this shows he did not do the work. The very reason I got him to do the work was for the water to be permanently diverted. As far as erosion if you take out the root system of a hill the hill will erode this is geography 101. So when he decided he was to take out all the bushes and the tree it should be expected to include erosion control or at the very least mention that this would be needed before he began the project. Also the water was to be diverted to the fence line away from the house and as the pictures I sent clearly show it this is not the case at all.

      6.      My “hostility and unprofessionalism” only occurred after he no showed and no called the visit to my house on the second of September. On Friday the first upon my return I contacted him and he said he would be out the next day Saturday. I touched base with him on Saturday as I had not heard from him and he said he was not coming out and I could not expect him to go to the seed store Saturday morning and be there though he said he would. This is when I became much more curt with the emails. I truly feel he was never going to come out and just used that as an excuse. I asked him multiple times to come and out to show me what he did and he refused.

      I paid for him to divert water from my house and he did not do that. I have had a couple people come out who are in the development business and they have all said the same thing he did not do the job he was paid to do as well as them asking why the tree was removed, they all said I got swindled. I have worked with many contractors in my day in a home setting and commercial setting and he is by far the worst I have dealt with.
