Beginning August 1, 2023, Bliss Nail Salon ownership began charging a 5% service charge for customers that used a debit or credit card to pay for their services. These charges are against the law in most cases:1. The ****** Amendment states that a business may not charge a service charge on debit card transactions. Surcharge fees are strictly limited to credit card transactions only. **** and Mastercard prohibit surcharges on debit cards or prepaid debit card transactions. Bliss Nail Salon charges 5% on all debit card transactions as well as credit card transactions.2. Businesses may impose a "usual and customary" surcharge to credit card transactions to not exceed 2%. Bliss Nail Salon charges 5%.3. The law states that businesses are to display adequate signage stating they charge credit card surcharges and the percentage amount. These signs are to be displayed on each customer entry door, at the cash register and prominently displayed on the business website, as appointments can be made online. In response to your complaint, we would like to clarify a few points:
Surcharge: Bliss is not charging a surcharge on the sale/service provided to the customer. We would like to clarify that it is a dual pricing model that is implemented to keep the cost low for customers who opt to pay with cash, whereas a 4% service fee will be charged if a credit card or debit card is used. Given the inflation of the last four years, this was a well-thought-out decision made by Bliss management to avoid passing on the burden to the customers while still keeping prices low.
Legality of Dual Pricing: Dual pricing, which involves applying different pricing structures for cash and card transactions, is legal nationwide. We have ensured that our pricing structure adheres to all applicable laws and regulations. Our aim is to simplify the process by letting us enter a single price (cash), promoting the concept of a "Card Price" alongside a "Cash Price."
Service Fee Percentage: Contrary to the information provided in your complaint, Bliss Nail Salon applies a 4% service fee, not 5%, based on business practices and legal considerations.
Merits of the Complaint: After review, we found no merit in the claims. Our service fee applies uniformly, within legal parameters.
Signage: we further assure you that we are fully compliant with *********** requirements as outlined by applicable regulations.
