I signed a contract with Allxteriors/Richard H***** on May 11, 2021 and gave him a $12,044 deposit. I was told the work would begin in 2-3 months. After 3 months, I contacted them to see why they had not contacted me to begin work and was told they were having difficulties and running behind. After 2 more months of not hearing anything from them, I again contacted them and was told again they were having difficulties and running behind. After several more weeks of not hearing from them, I again contacted them and pressed for some kind of timeline and a few days later received an email indicating a start date of November 15, 2021. On November 14, 2021, I was contacted by Richard H***** and told they would NOT be starting the next day as I had been told, but that it would be soon. After not hearing anything from anyone at Allxteriors for another 3+ weeks, on December 7, 2021, SEVEN months after signing the contract, I decided to cancel the job and requested a refund of my deposit. After going back and forth with him for a couple of weeks, he sent a check for half of my deposit with no explanation or reason for why he only sent half. I had not agreed to that. The contract does state that cancellations will incur a penalty, which is what his claim will be to keep the remaining $6,022 he now has. My complaint is that his contract also states that “jobs will be scheduled in a timely manner” and seven months with no projected start date is not a timely manner and in my opinion is a breech of contract and should entitle me to a full refund of my deposit.Business response

First, on our contracts there are terms that the clients are made aware of when the estimate is sent to them; they also sign them when they sign the contract. Part of the contractor’s agreement, which is standard for the state of South Carolina, states that after a 24 hour period any refund will be a 25% refund. Once materials are purchased there is no refund.Second, we kept Mr. ****** informed about delays regarding finding additional damages at the jobs that had signed before him. One such contact was November 3rd. He understood and on that same date approved the gutter color choice (Linen 44). This is not a common color and as such can’t just be used on another house. The gutters were ordered November 5th. At 9:55 am. November 14th, Richard met with Mr. ****** and picked up a color swatch (SW-green rosemary and SW-cream base kestrel white).At this time, at his home, Richard discussed the reasons for the delays (hidden damages and a termite infestation on the client’s house before him). It was discussed that Richard would be back in contact after the holiday and agreed to at that time. Richard then received a text from Mr. ****** on December 7th stating that he wished to cancel the contract.We reminded him that per our contract that there would be no refund due and that we were still wanting to perform the work on his home because we knew that he would be pleased with the quality of work. We did, however, reconsider and sent him a 25% refund due to all of the delays.We are sorry that this did not work out.Melissa H*****Allxteriors
