      Business response

      11/20/2023

This is the Head Manager at Upstate Cycle. We would just like to respond to the complaint filed on us from ******* ****** on 9/7/23. Mr. ****** came into our shop on the 14th of April 2023 and purchased a ***** **** **** ********** from us. At this time we were not set up to do in house registration for the DMV. We would write up a shop bill of sale, a 400 form, a SC bill of sale, and we would fill out the MSO so that our customers have everything they need to go down to the DMV and register their vehicle to get the title, metal tag, and everything else they need. After giving Mr. ****** all of his original paperwork and us keeping the copies for our records, he left happy as can be with his new machine. After a few months we received a call from Mr. ****** where he is yelling at us because he managed to get his bike stolen with all of the original paper work inside the bike without ever registering his motorcycle. The owner was the one who answered the phone and was trying to calm down Mr. ****** who isn't the easiest to understand. After Mr. ****** finally explained what happened to his bike and paper work the owner responded "you screwed up big time" which in better words set off Mr. ******. The owner tried to calm him down with no success, after going back and forth over the phone the owner said he has other customers he needs to attend to and had to place the phone down because Mr. ****** would not stop yelling and making threats towards our business. Later that day he called back and this time it was me who answered the phone. Mr. ****** began the conversation with an apology for the way he acted over the phone and blamed it on his ADD disorder. I apologized for what ever confusion there was and asked if he would explain what he is going through so I could do my best to help him further. He stated that he never went to get the bike registered and would just ride around with the paper work in case he was pulled over. Later the bike got stolen with the paperwork still inside, so for the insurance company to give him his money he needs to have proof of ownership. I responded, telling him I only have copies of his paperwork and if that was sufficient I would be glad to give him a copy of our copy. He said yes and that he would be by that day to pick up. Once he came in, I made a copy of his shop bill of sale and in the copier it didn't really come out legible, I told him he could take a photo of it or I could rewrite over the very faded letters from the copier so it was readable. He said that should be fine with the picture and left satisfied. Basically a day later he calls complaining again that we wouldn't give him his original paperwork. We no longer have the original paperwork. He had the originals and lost them in the bike. After explaining this to him he was not happy and kept threating to report us to the BBB because of this. I told him if he needs to get the originals he would have to come pay us so we could order a new MSO and have it sent in, and then we could rewrite our paperwork for him. He was not happy about this but we don't do things for free especially when it costs us money. Mr. ****** came in, paid $50, and we ordered it the very next day, because he came in at the end of the previous day. As soon as it came in, I called him immediately and got no answer. He called a day later asking where his paperwork was and we told him its here and ready to go. He came in and picked up his paperwork and said how grateful he was that he can finally get this all over with. He even asked about getting another bike from us and said he loved doing business with us. We said we have no problem continuing to do business with him but if he is going to submit a formal complaint about us after everything we went though to help him that we would no longer be doing business with him because we don't want the trouble. He supposedly got everything taken care of and still filed a complaint.

This is everything I can tell you about this ordeal and we are hoping that this won't affect us negatively considering this was of his own doing. If there is anymore questions or concerns please don't hesitate to call or email us.
