      I originally hired this company to install an inground pool. I gave a deposit of $13,847.48 on March 17th, 2022. On or about October 24th, I learned the man who was building the pools for this company quit because a lack of trust and financial disclosure. At that time, I requested our deposit back and notified the owner, Shane Gilchrist of my decision. After numerous emails requesting my money, I was told " give me two or three weeks." After that time had elapsed, I again requested my deposit back and was told he didn't have the funds. Shane Gilchrist also informed me his company will be reimbursing me $12,579.98 of my original deposit, for their "services." This company didn't do any site visits, and used a rendering we submitted to them. They filed a permit with the town, but it was not paid for.

      Good morning! I am reaching out regarding the complaint filed with our business. 
      I have spoken to this individual several times, and have sent a check in the amount of $1000 last week. We are working on getting the deposit back to them as soon as we can in the amount of $12579.98, we have paid $1000 of that amount. 


      See attached our contract that was signed by the ****** family on 3/16/22.


      This contract is between Gilchrist Masonry and Pools. They chose to not move forward with our business because we had an employee quit and start his own company. 


      We had spent several hours with several different employees working on the permit, and having things move along. We waited for several months for the family to have a COO, that was not received until 10/4/22 the ****** family then asked for a refund on 10/24 when we had already begun the process to begin the pool. 


      Please let me know if there is anything I can provide to show further proof that we are working with this family to come up with a solution that is fair for everyone.

      I am rejecting this response because:

      My family chose not to move forward with Gilchrist Masonry and Pools because the “Pools” part left the company because of the lack of transparency and financial issues, as per their former pool expert. We signed a contract with Gilchrist because of their former employee who specializes in pool construction. After hearing from their former employee that he and his team left Gilchrist ,we then we’re not comfortable going forward with a one hundred thousand dollar project with a company that doesn’t have much experience with constructing pools. We also heard from other customers of Gilchrist’s who advised us that they were breaking the terms of their contract and demanding  future funds that were not yet payable to the company based on their contract. 
      This company did not send out the one thousand dollar check until after we filed this complaint and they received notice of such. They even sent it to the wrong address until I advised them of such.They also never responded back to my email when I asked “ how much time” it was going to take to refund my funds, which they never responded to. 
      As per their former employee, Gilchrist spent zero dollars on my project, other than an employee fee to their former pool guy. They never made any site visits, and we sent them the rendition of the pool we wanted. All they did was submit a permit to the Town , which wasn’t paid for. We gave Gilchrist a deposit of  $13,847.48 back in March of 2022. They had our funds and utilized them for projects other than ours. When we requested the full amount back, they decided to pay back only $12,579.98. Due to the fact that they spent my funds on a different project of theirs, and since we are unable to move forward on our own projects due to lack of funds , we should be reimbursed the full amount of the deposit. There’s no telling how long it will take Gilchrist to refund me the full amount. A companies financial woes should not be the problem of the consumers.
