      I booked a wedding in July with Simple Wedding LLC. Since our situation changed out of our control. I was asking for our $125.00 deposit returned. The company declined stating it was nonrefundable. I was not made aware of this policy until after the Deposit was made. I never signed a contract with this company excepting these terms. I was even told that others were interested in the date we picked. I would like help resolving this issue and receive a full refund. Thank you.

      Dear BBB,

      Thank you for your email and contacting me about the complaint issued against Simple Wedding Day, LLC from ****************************  She contacting me on March 12, 2023 about her cancellation of the wedding she had booked with my company for July 17, 2023.   The day she booked her wedding with my company, after discussing and answering many questions about her wedding day and what I can provide for her, she decided to book her wedding with my company.  Once a couple books their wedding with me a deposit is required to secure my services, which includes my services prior to their wedding day as well as on their wedding day.  The deposit amount was $125.00 as she stated.  The deposit is non-refundable.  I tell every client verbally and state it in writing about the non refundable deposit whether one remembers it or not.  It is only non-refundable if the wedding is cancelled all together.  If travel issues are a concern and a new date has to be selected then the deposit is moved to a new date.  As I stated to her, I did have some inquiries from others about her date and time, but I had to tell prospective clients I was sorry but their requested date and time was not available since ******'s wedding was already secured and on my calendar. Therefore, those leads are lost after ******'s wedding was on my calendar. Once a client has booked with me I send out the contract/conformation email to them about their wedding day details and one of those items mentioned is the deposit paid is non-refundable if the wedding day is canceled. 

      When ****** contacted me about her cancellation, I did respond to her and stated her deposit was non-refundable.  After she mentioned her reason for her cancellation was due to their parents not able to travel from their home town to another destination (************, **), I offered a partial or full refund to her if I was to book a wedding from another client for her date and time as long as the package booked with my company is comparable to the package she had booked with my company.  But that partial or full refund would have to come later time.  I thought that was a fair and reasonable offer even though the deposit was stated as non-refundable if their wedding day is cancelled.  She stated she is requesting a full refund now not later.  She stated as well she would file a complaint with the BBB because I was not offering an immediate refund as my calendar for the original date is still open. I did offer a solution and concession I thought was fair in attempt to help her.  She did not want that offer. I also stated if she filed a complaint with the BBB as she stated she would do that I was considering the matter closed.

      I am rejecting this response because: I was not made aware of the nonrefundable  deposit until after the monies were taken from my account. It was in a long email with alot of details that I received after the fact, which then is to late. I also did not sign any contract agreeing to these terms. This seems to be a shady practice. 

      ************ is a very popular destination.  Rev ***** stated that he does hundreds of weddings per year. I feel I gave a long amount of time for a cancelation.  I could understand if this was July .

      As far as time spent it was one conversation that lasted 15mins.

      I have had more correspondence with him asking for a refund then planning my wedding. 

      The services were not rendered and I would like a full refund .

      I am prepared to take this to small claims court if we can not resolve this. Were I will ask for additional damages. 

      I  am also prepared to make this business practices public through online reviews and weddings sites.
