I wanted to see what sort of loan I qualified for. After completing the application, the amount of the loan offered was far lower than was acceptable. Additionally, the interest rate is 684%, 16 payments of $189 over 16 months for principle amount of $600. That, as far as I know is usury. I closed the web page, and I DID NOT ACCEPT THE LOAN. To my horror, I found the loan was processed anyway, and $600 was deposited to my checking account. I have emailed a notice of cancellation but have not yet received a response. We are in receipt of your recent complaint and concern related to the loan you received from WLCC Lending HBC DBA National Nation Loans (the “Company”) and would like to take this opportunity to respond.
Please be aware that the Company is an entity of the Wakpamni Lake Community Corporation, a tribal corporation wholly owned economic development arm of the Wakpamni Lake Community, which is a local subsidiary government under the Oglala Sioux Tribe (the “Tribe”).
The Company takes these types of inquiries very seriously and would like to provide you with the below information. However, nothing in this communication should be construed as a waiver of the Tribe’s or the Company’s sovereign immunity, all of which are expressly preserved.
The Tribe is a federally recognized Indian tribe, organized under a Constitution pursuant to the Indian Reorganization Act of 1934, ** ***** **** ** ****** ** **** ** ***** as amended, and is identified on the ****** ****** ********** ** ********** list of federally acknowledged Indian Tribes. 81 Fed. Reg. 26,826 (May 4, 2016). The Company is an arm of the Tribe. As an arm of the Tribe, the Company possesses all of the privileges and immunities of the Tribe. The Tribe and the Company are entitled to tribal sovereign immunity and they are not subject to state law. ***** ***** ***** N.A. v. Lake of the Torches Econ. Dev. Corp., 677 F. Supp. 2d 1053, 1061 (W.D. Wis. 2010) (holding that entities acting as arms of a tribe are entitled to tribal sovereign immunity).
You have expressed concerns that while you did apply for a loan, you did not authorize or sign for a loan with National Nation Loans.
According to our records, we received an electronically-signed loan agreement, which is signed by clicking the ‘I Agree’ button on the loan agreement, in your name to borrow $600 from National Nation Loans on 3/28/2024. Per that agreement, the $600 was deposited into your J******* ***** **** account ending in ***** the bank account listed on the agreement, on 3/29/2024.
Prior to full review of this complaint, we had already scheduled a reversal of that deposit to post on 4/3/2024 in the amount of $600.
Once this debit transaction clears, your account will be considered to be paid in full and closed. There will be no balance due at that point.
If you believe that we did not receive your account as described above, please let us know so that we may assist you further in investigating the issue.

In January I received a loan for $300. I have since paid that and some more off. It said that I was almost done with my payments, but now I’ve been asked to pay way more. Almost $1100 in total for a $300 loan. I would like to talk to someone about considering my account settled and closed since I have paid the loan amount off and more in interest.Business response

I have a loan with this company (Fast Fund Lending, ************************* ************* *********************************. I have never had a late payment or had a payment decline with them. But it is coming close to the time when my scheduled auto payments will be ending and my loan will be paid in full, so I reached out to the company asking to get something in writing to acknowledge my final payment date. I emailed for a week straight. I called and talked to a representative, a supervisor, and a manger. They all refused to assist me with this, unless I miss work to get on a conference call with them so they can call my bank to verify my contact info with my bank. This company is auto withdrawing money from my account every pay period but has the audacity to refuse to send me an email stating when my last payment will be unless I can take time off work to get on a call with them and my bank. There is zero need for them to verify anything with my bank at this point when my loan should be almost paid off and I have never missed a payment, never been late on a payment etc. This is the most unprofessional company I have ever encountered and the people who responded to my emails (when they bothered to respond at all - sometimes my emails went unanswered) claimed to not know who I was after I gave them my full name, phone number, last 4 of my SS #, my case #, my application # etc. They are trying to claim that their refusal to help me by simply responding to my email and letting me know my payoff date is for protection of my own privacy, but its obvious that their refusal to state my final payment date in writing is so they can continue to charge you after its paid off.Business response

I took a loan out with first day loans and it was a ridiculously high interest rate like 400 or 500% interest, so I called to pay off the loan early on December 13 and I was told to pay it by debit card and I did in full. Two days later the company took an ACH from my bank account unauthorized for $14.25 the company refuses to give me my money back today as they want me to do a three-way call to verify that the money was taken from my account now they have the ACH I would not have known the amount of the ACH if I didn’t check my account so that it was taken and I’m not giving a company a three-way call where I have to enter in my security, information, pin, and password with them on the call when they stole money from me. They also are charging illegal interest by the state of Ohio rules. ********************************************************Business response

The interest and fees applicable to the loan are permitted by Tribal law and they were accurately and

and in an effort to resolve the Customer’s concerns, we have already refunded the funds today,

I am rejecting this response because: I have since received another charge of $35.41 because they made me pay by debit card and their operation is not even in the United States. It’s in another country, so therefore it was held as a foreign transaction by my bank. It shows that they are clearly misrepresenting their tribal affiliation as they’re not even in the United States and, like I stated before they violated Ohio laws, as they are not licensed to do business in Ohio, and I am in Ohio, and they violated Ohio’s maximum interest rate law, so I would like my interest returned, as well as the fee that I was charged by my bank. I just want my money back if they’re not gonna do that then I’m gonna report this to the Iowa Attorney General’s office as well as to see if PB because they are misrepresenting themselves in acting unethically and possibly illegally

I took out a loan with this group DBA DAkota funding group earlier this year in an emergency. I have made payments and I still owe way more than I borrowed. I have also since found out these type of loans are illegal in my state. My husband has now lost his job and I am off work havign to care for my mother. I can not make these payments. I applied to see if I would qualify for a loan thru a website that was NOT ******** ****** *****. Apparently that company forwarded on my information to other loan companies to see if I would qualify for a loan. ******** ****** ***** was one of those companies. I never directly applied with them nor did I accept a loan from them, sign any documents or provide my banking info. However, the lender deposited $500 in my account on 11/21 and started debiting my account for $158.09 on 11/30. I have attempted to contact the company during their stated business hours and only get and answering services and no call back. I received a vague email and responded back with my concerns and of course I’m sure I won’t get a reply or it will be more vague dialogue. This company knows that their practices are deceptive and downright criminal which is the reason they give the run around. I’m sure I’m not the first person to experience this nightmare. I only realized this situation on today 12/4 when I reviewed my bank account in detail which I do once a month. After researching I discovered I’m expected to pay back over $2,000 for a loan I never authorized and never accepted and how exactly are they obtaining consumers bank account information if we aren’t providing? This is definitely can’t be in compliance. I work at a financial institution so I definitely would know this isn’t kosher. Then it appears they hide behind the veil of we don’t fall under traditional government and fall under the Wakpami Lake Community Government laws which of course isn’t easy to locate what those laws consist of. Definitely unscrupulous practices. I am returning the $500 minus the $158.09 debited from my account and want all future debits to my account cancelled. WLCC Lending HBC dba ******** ****** ***** is a tribal governmental entity, it is a wholly owned subsidiary of Wakpamni Lake Community Corporation (“WLCC”). WLCC is the wholly owned tribal economic development arm of the Wakpamni Lake Community government, a subsidiary municipal tribal government of the federally recognized Oglala Sioux Tribe of the Pine Ridge Indian Reservation (“Tribe”). According to our records, we received an electronically-signed loan agreement, which is signed by clicking the ‘I Agree’ button on the loan agreement, in the Complainants name to borrow $500.00 from National Nation Loans on 11.21.2023. Per that agreement, the $500.00 was deposited into ****** ************ ******** account ending in -****, the bank account listed on the agreement, on 11.22.2023.
We understand that ****** ********** may not have realized they were signing the loan agreement when the button was clicked.
However, due to their concerns, we can begin the process of cancelling their loan and closing the account, but first we must receive back the entirety of the principal that we deposited into bank account information on file.
A scheduled withdrawal in the amount of $500.00 is to be debited from the bank account on file. We are proposing that this transaction take place on 12.15.2023. We note that the initial payment that we processed according to the loan agreement has been returned to us on 12.4.2023 as an R10 returned payment, making the transaction unsuccessful.
Once the total principal amount has been retrieved successfully, the cancellation process will be complete and the account will be closed with no balance due.

Was lent $500 and was supposed to be a set total number of payments but my balance never changer goes down to 8 something and now back to $933 since loan was funded on 8-28-2023 with me paying $80 a week and they provide a phone number that has not worked in over 2 months even when they provided me through text with the same number ************ to speak to a customer service rep this is just a rip off for them to keep charging $80 a week and no payoff in sight and can’t see the total loan agreement on line only shows you upcoming payment nor access to the contract a total scam being ranBusiness response
