      Amy Stockberger is a realtor in the Sioux Falls area. We hired her at the recommendation of a friend for the sale of our home to help us move to Nashville, TN. Unfortunately, her work with us was riddled with difficulty and stress/strife. The primary concern related to the amount below is that per our disclosure documents and our contract, the buyer, which she was a dual agent for, was to take over our CRP on the land we had in Brandon, SD. Unfortunately, Amy did not have them follow through on this, and we had to pay a fine. This was in the amount of $888.71. We have now contacted through email, text, and phone Amy Stockberger and her office to have the buyer refund us back this amount and they have not. This is a breach of contract and is very frustrating for us that this amount of money had to be payed as a fine to close our contract which should have been continued by the buyer. The second issue is that Amy did not represent us well as a dual agent. She definitely had the buyer's interest in the foreground and took all of their recommendations and did not listen to our side of many of the deliberations. I am sure this violates multiple real estate laws. The third issue is that her real estate agency recommended a mover (A plus moving company) and she had him listed on her recommended mover list, who was not bonded, was not insured and we later found out that he violated multiple state and federal laws in moving us. He destroyed our front property and charged us triple the amount of what was originally contracted. Finally, Amy was recommended to us by another realtor. We later learned that there is a referral payment that real estate agents get, and when we told our friend all about the difficulties she had created for us, she apologized for the referral but then told us that she, too, was having trouble getting her referral fee. It was not until several attempts and several months that she finally got this.

      Below is a breakdown of the timeframe of your listing, the list price & the sold price. We went on the market December 15, 2023. There had been 7 showings and no offer up until my Buyer submitted their offer of $1,099,000. We then countered the Buyer back at $1,124,000. At the time of the final walkthrough, it was noticed that there was significant damage to the interior walls. I paid the $2,000 to have the walls fixed.

      12/21/2023 - CRP documents were received from the Seller. 
      12/22/23 - Documents were sent to Buyer, including the Southa Dakota Management Worksheet and attached pictures: CRP2.jpg, CRP3.jpg, CRP4.jpg, CRP5.jpg
      2/23/24 - Home closed 
      4/10/2024 - Email received from Seller about the CRP and money owed. 
      4/11/2024 - Resent the Buyer the CRP documentation. 
      4/12/2024 - Sent followup email to Beards with an update. 
      4/28/2024 - Buyer asked for Seller's number to contact him in regard to the CRP and response of giving the phone number.

      I was not aware that the other agent had not been paid her referral fee until ***** notified me. I had an employee who made a mistake on the referral fee and the payment was delayed.
