      Contractor began metal building construction on 10/26/20 without completing the promised written contract. Excavation started on the wrong property, expecting customer to compensate the other landowner. Although freely issuing verbal guarantees and assurances that the building would be erected to fit a large pre-selected bi-fold door, they failed to consult factory specs in order to accomplish this, even after being reminded of the importance several times. Improperly completed framing to the incorrect specs, failing to accomplish this primary objective, while stating that the manufacturer would correct the issue; all while ignoring owner's objections. Refused to acknowledge that the building would not accommodate the door, or to compare building vs door specs to answer owner's concerns. The Required re-design engineering correction, destruction, fabrication and repair to the structure was left to the owner, as was damage repair due to miscut siding. Promised that culvert damaged by concrete trucks would be replaced; failed to follow through. Demanded final payment before final installation of all anchor bolts, entry doors and industry-standard number of corner trim screws, plus a garage door which they falsely claimed that they had on order; all with full assurances that all deficiencies would be promptly completed "this week-end". Further, they promised to correct any problems encountered by owner. This punch list is still not completed some 15 months later. Failed to install standard eave trim flashing/weather-seal and did not advise owner, leaving the owner to discover these items on his own. Manufactured says that they delivered it. They skipped eave trim on two other buildings in the area. Affixed their advertising logo to the apex cap of the building without owner's permission, while covering the manufacturer's logo. Owner has attempted contact for months; was Promised in October to finish; unavailable since. Owner told, "get a lawyer, it won't help"

      Business Response /* (1000, 5, 2022/01/15) */ We were hired to install a prefab building the customer purchased from encore steel buildings the building was built to the specs of the building prints we are not responsible for the engineering of the building or the damage do to the door company the customer hired . Consumer Response /* (3000, 7, 2022/01/19) */ (The consumer indicated he/she DID NOT accept the response from the business.) ***'s response ignored more than a dozen of my complaints and responded to one which I did not submit; that being damage caused by other contractors. *** is the only entity which has done damage to my project. They failed to refer to their most recent, and possibly most serious violation of industry-standard practice in the areas of technique and ethics, displaying no awareness that verbal assurances and representations become part of the contract with the customer. They promise much and deliver little. In October of 2021, they promised to complete my building, to include: (1) replacement of one miss-cut siding panel, now pending for some 15 months, and (2) proper installation of **** Trim flashing which they failed to do during construction before demanding final payment in full. They then said that they planned to accomplish these repairs, but refused to give any estimated date of completion, only responding that "the weather is against us", then refusing any further coordination through text, phone or email. They also verbally claimed to be willing to compensate me if I desired to use another contractor to accomplish these actions, but when I requested that via phone message and text, they refused to communicate. The manufacturer tells me that the assembly kit which *** received included **** Trim with weather seals. *** represented themselves as agents for the manufacturer, Encore Steel Buildings; that they were personally acquainted with executive management and had the ability to require them to comply with contracts and standards, and that as contractor, *** was qualified to accomplish the project which I presented to them. See attached color selection chart bearing the *** logo, and preliminary and final contracts which *** submitted to Encore. The final sales contract contained the requirement that the building accommodate the door. Before my building was constructed at the factory, when I questioned whether the building specs would accommodate the already ordered, ******** bi-fold door, *** failed to compare door specs to building specs even though I provided building specs and two copies of door specs. They signified that they understood the importance of insuring that the building design was compatible with door design, but after assembly started, they refused to honor my request that they leave exterior siding uninstalled to accommodate door installation per specs. They insisted that the door could be merely attached over the siding in spite of directions in the door specs. *** also represented themselves as being willing and able to coordinate workarounds to accomplish the project which I agreed with them to complete. *** owes compensation to cover expenses to complete my building.
