Cherokee had my trailer on their property for almost a month while I was waiting on my UTV to be repaired. **** (sales rep) called & asked if I came & got the trailer. It had been stolen from their lot. I called the pole & filed a report. The office manager said it wasn't be covered by their security cameras & to claim it on my insurance. My insurance didn't cover it. I would like for Cherokee to replace it. I was notified, by ***** on March 3 about the trailer missing.Business response

MR ***** WAS NOT TOLD BY ANY CHEROKEE POWERSPORT EMPLOYEE TO LEAVE HIS TRAILER UNATTENDED ON OUR PERSONAL PROPERTY. HE DROPED HIS MACHINE OFF FOR SERVICE AND DECIDED TO LEAVE IT HERE HIMSELF. I DO NOT PROMOTE OR ENCOURAGE ANYONE TO LEAVE ANYTHING HERE THAT WE ARE NOT WORKING ON AND SIGNS ARE POSTED IN FACILITY STATING THAT WE ARE NOT RESPONSIBLE FOR THEFT OF YOUR PROPERTY THAT YOU LEAVE HERE SIMPLY BECAUSE YOU DONT FELL LIKE DRAGING IT BACK HOME BEHIND YOU. **** TOLD MR ADAMS DIRECTLY THAT HE SHOULD NOT LEAVE THE TRAILOR ABD IF HE WAS HE MIGHT WANT TO GO PURCHASE A LOCK FOR IT. AGAIN NOT MY PROBLEM ANY ANY LEGAL FORM OR FASHION IF YOU CHOOSE TO BE LAZY ABOUT YOUR PROPERTY AND IT COMES UP MISSING. THIS MATTER IS ABOVE AND BEYOND ANY SCOPE OF YOUR ORGINIZATION AND IF MR ADAMS WISHIES TO PURSUE THE MATTER FUTHER HE SHOULD HIRE AN ATTORNY.Business response

OK GUYS HOW LONG ARE YOU GOING TO KEEP ENTERNANING THIS GUYS COMPLAINT. HE JUST ADMITTED IN THIS LAST COMPLAINT THAT **** TOLD HIM TO LOCK IT IF HE WAS LEAVING IT BECAUSE WE WERE NOT RESPONSIBLE FOR IT.
PLEASE ADRESS THIS ISSUE WITH COMMON SENSE AND QUIT WASTING MINE AND MY TEAMS VALUABLE TIME.
YOU CAN NOT JUST PARK YOUR PERSONAL BELONGINGS ANYWHERE AND THEN HOLD EVERYONE ELSE RESPONSIBLE FOR YOUR LOSSES

I am rejecting this response because: Even though **** asked me if i had a lock, he told me about the security cameras you had. Also why didn't you place a lockon the trailer when you had it for so long! Common sense should have prevailed.

On 7-10-23 we bought a new Massimo side by side for ******* and issued a check for that amount. After we bought the side by side the lady told us that we would have to pay someone to get the cart home. We are 81 years old and do not own a trailer. She suggested that one of their employees would deliver it to us for ***. He brought it to us that afternoon & we parked it in the garage. The next day we drove it but it acted like the emergency brake was stuck. The mechanic at the shop told us it was ok that it just needed to be broke in. It even got hot when we drove it. Very difficult to drive. We called on Wednesday and told the business we were bringing the cart back. He informed us that they did not refund our money. Today we took it back to them and he called back saying a few things were wrong with it and we just told him we did not want the cart because there was a bad taste in our mouth. He got real smart with us and argued with us saying that would cause a big deal if the check was stopped. I did stop the check on Wednesday. He went so far to say that they would prosecute us. What are our rights? Please help us.Business response

** ****** SIGNED ALL PAPERWORK REQUIRED BY THE STATE OF TENNESSEE AND TOOK OWNERSHIP OF UNIT. HE THEN CALLED AND SAID HE COULD NOT AFFORD THE UNIT AFTER TALKING TO HIS SON AND HE CANCELLED THE CHECK THAT HE WROTE THE DAY HE TOOK POSSESSION OF THE UNIT. IN ACCORDANCE WITH TENNESSEE LAW THERE IS NO COOL DOWN PERIOD AND IT IS HIGHLY ILLEGAL TO TAKE DELIVERY OF A PRODUCT (WICH MEANS IT IS NO LONGER NEW) AND THEN CANCELL THE CHECK. ANY OTHER DEALER I KNOW WOULD HAVE HAD HIM CHARGED WITH GRAND THEFT AND PASSING BAD CHECKS. I ALLOWED THE RETURN OF THE UNIT AND CHARGED HIM A ****** RETURN CHECK FEE. HE PAID THAT FEE WITH A PERSONAL CHECK DATED 7/25/2023 AND CHECK #3657 DRAWN ON HOMETRUST BANK. I SHOULD HAVE CHARGED MORE HAD I KNOWN THAT THIS HERE WAS GOING TO BE TAKING UP EVEN MORE OF MY VALUABLE TIME. MR. MORROW ALL IN ALL IS TAKEN CARE OF IM THE ONLY ONE OUT AND HE HAS BEEN ADDED TO OUR DONT DO BUISNESS WITH LIST
