I entered a contract with , Moldtox on March 27th, 2022. The contract was for waterproofing services which involved excavation down to footers, vapor barrier & repair to existing bulkhead/exterior entrance to basement. I was given a completion date of 2.1/2 weeks. I was told by that he had 6 employees I only saw 2, and eventually he was down to one, his son. I was quoted 9K . I paid 3K down via wire transfer from Planters Bank. After a month of delays, unrelated to weather, I informed that I wanted to cancel the job, as of April 1st, NO work had been started on my basement. agreed to cancel the waterproofing job, (in writing) but refused to refund my deposit of 3K. After going back & forth, he refunded 1K but refused to refund 2K remaining, instead reallocated my money (I was NOT given a choice) to a seperate remodeling job (for which he was paid $1500 to start, remainder of $1500 UPON COMPLETION per our seperate contact. Again, deadline was missed, extended for weeks as his 1 employee was working average of 5 hrs week. Terrible work ethic, constant excuses. They ruined my tile job. Electrical was never completed. Materials (electrical) & wasted (tile /lumber). Job dragged on for 8 weeks... To date, Daniel collected $4500: $3000 Deposit for waterproofing job that he NEVER STARTED/agreed to terminate $1500 for Remodel job that was only 1/3 completed, tile job so shabby that it's going to have to be demolished & completely redone. I have proof of all of this in writing, pics & texts messages. I reached out to (owner) as well & have not received a response. blocked me on FB & refuses to respond to calls/texts.

      Business response

      05/11/2022

Business Response /* (1000, 14, 2022/05/11) */ ***Document Attached*** I can not believe some of the accusations of . My brother, , done everything in his power to satisfy this customer to no avail. Our impeccable record for the past 18 years in business shows what a honest and reputable company I own. money was refunded on 4.19.22 and I'm enclosing the paper that she signed to release my company from any further obligations to her. Consumer Response /* (3000, 16, 2022/05/16) */ (The consumer indicated he/she DID NOT accept the response from the business.) I do NOT accept the above written statement From the owner. misrepresented himself, and fraudulently claimed to be licensed (under his brother's name) for remodeling/construction , when he'd clearly lost his own contracting license. He then proceeded to hold my deposit for the waterproofing job (never started, after weeks of rescheduling, finally mutually agreed to cancel the waterproofing contract) withhold my deposit to keep me from firing him for remodeling job. I have pictures & written statements from new contractors, as well as documented texts & evidence from to show the work...all of which had to be ripped out. I'm STILL dealing with the dangerous , shoddy work from UNLICENSED electrician subbed out to a cobbler he'd hired. I only agreed to accept my refund for Basement remodel, that he held for 2 months , as this contract was mutually cancelled by both parties, back in MARCH 2022. The remodeling job, has still not been refunded and I'm still out 2K plus damages to ceilings, electrical & tile/paint. I did NOT agree to settle that agreement, which was a seperate contract through/WITH MoldTox. I am still pursuing legal/civil remedy + damages for this contract. Business Response /* (4000, 25, 2022/08/22) */ I have forwarded the settlement agreement which Mrs has signed and issued her a refund. I don't know what else this woman wants from Mold Tox. I've heard she has hired several different contractors only to run them off just so she didn't have to pay them. I have ran across a few of these "type" of customers in the past and am not falling for their antics just for them to receive a free job. This case is closed in my book and should be in hers as she can not take this matter in further because I have a signed paper from her that this matter is SETTLED!
