We placed an order for a white vinyl fence with **** *******, owner of Middle Tennessee Fence in Brentwood, ** on June 2, 2021. On or about September25, 2021 (4 mos. later), we informed Mr. ******* that due to his inability to provide us with an installation date, we wanted to cancel our order. Mr. ******* indicated we would be charged a cancellation fee of $****** assessed by the fence co. He told us to read the contract wherein it stated there would be a cancellation charge assessed by the manufacturer if we canceled. Note: there is nothing in the contract we signed stating this cancellation charge would be assessed. The information he stated is false. He also said that the fence manufacturer only provided refunds on the 15th of each month, & that when he received the refund (minus the $******), he would then forward it to us. We did receive a check finally on October 29th, it was dated October 22, 2021, and it was signed by **** ******* with an address of ************* Dr College Grove, ** XXXXX, email: **********@gmail.com. Stated on check was "partial refund for deposit on fence".This check was not from the fence manufacturer. Mr. ******* continually lied to us about the installation date, indicating he had no idea when would would have the install. I contacted him once while he was hunting in Montana for 2 weeks, and he said he had no information with him about our fence & we would have to wait 2 weeks until he returned back to **. Upon his return, I contacted him again and he still wouldn't give specifics. We paid him $**** as a 50% deposit on the day we signed his contract. We paid this money up front & was very shocked when he said the fence manufacturer would charge us $****** for cancellation. He then went out of town again on "fall break" delaying our check return even longer.We never met in person, he did the quote using our land plot from our builder. RED FLAG should have been raised then.
