A Transaction Contract for installation of a patio cover to provided by Owens Construction, 9041 Hiwassee Street, Charleston, TN 37310, was made on Sept. 30, 2021. The date of transaction on the contract was dated incorrectly. It read 9-8-2021 but should have been 9-30-2021. I reached out to Owens by phone, text and email to correct the mistake, but could not get a reply. Owens required a check deposit from me of $2,500.00 for materials and to do the work. Owens was to pick the check up from under a mat at my home. I noticed the check was gone and tried to contact Owens to see if he picked up the check. No response. I did not know if the check was stolen. I sent a certified letter of Right to Cancel to Owens Construction to cancel but the check was cashed anyway. I respectfully ask that my deposit be returned ASAP. I have exhausted all possibilities of contacting this company. Email, Text and phone have not been successful.Business response

Consumer Response /* (3000, 11, 2022/01/21) */ I have not heard back nor received a return for my deposit of $2,500.00,made in September of 2021. It is now Friday, January 21, 2022, and still no communication. Consumer Response /* (3000, 12, 2022/01/21) */ I received a call on Dec.16, 2021, informing me that materials were still not there at Owens Construction, I found it very odd that he wanted to make an appointment for install when he said that the materials were not there yet. I spoke and texted him to please refund my $2,500.00 deposit. Business Response /* (1000, 18, 2022/02/07) */ Feb/7/2022 Put a refund check in the mail for $2500 Business Response /* (1000, 19, 2022/02/07) */ Feb/7/2022 Just saw the email on this complaint. For some reason I did not receive any of the prior emails about this. I will be sending the customer a $2500 refund check through USPS mail today. Will provide tracking info. The customer did cancel but decided to move forward with the project a week later. We did order materials and tried to schedule the install but he decided to cancel again. Consumer Response /* (2000, 21, 2022/02/08) */ (The consumer indicated he/she ACCEPTED the response from the business.) I do accept the return of my deposit from Owen Construction. Their response to the BBB about the situation was only partly true. I personally informed them of the complaint in December. They were aware of the complaint. Communication was a major issue in my proposed job with Owen Construction. As the BBB knows, they, too, had communication problems with Owen Construction and said they did not know of the complaint until now. I will see if the company follows through with their promise to return my $2,500.00 deposit.
