I have damage in my bathroom that is extremely significant. My insurance company came and said that the damage was from a shower pan being installed wrong in my home that was built in XXXX-XXXX. There has been water leaking since the home was built, but was unable to be seen because it was under the floor. The insurance company will not cover the damage because they consider it "long term" damage. We have reached out to the builder several times to discuss this matter and they will not return contact. We are having to pay 12k or more out of pocket to gut and replace rotted floor joists, moldy insulation, walls, tile and flooring in a home that is THREE years old due to a mistake or oversight of the builder/construction company. I have attached the invoices for the materials we have had to purchase thus far, and photos of the damage. We can get a copy of the report from the structural engineer and a statement from out insurance company.Business response

Business Response /* (1000, 10, 2022/05/03) */ Mr. ******'s home was built 4.5 years prior and he has been living in the home for 4 years. He stated he had reached out to us "several times" and that we did not return contact. However, we received a website notification from Mr. ******'s wife about this issue on 3/14/22. Our company warranty manager responded on 3/15/22. When speaking to our warranty manager, Mr. ****** threatened legal action. It is our standard company policy when a person threatens legal action to immediately stop communications and turn the matter over to our attorney. I contacted Mr. ****** to see if this was going to be necessary. During our discussions, Mr. ****** stated he would send over his engineers report as well as the insurance assessment. As of this response, I have not received any information from Mr. ******. Mr. ****** did not notify ****** Homes until after the bathroom was demolished. His purpose as stated in the complaint is for a "refund". Our company does not pay for work done by other subcontractors, especially when we are the last to be informed of the issue. This is merely a money grab by Mr. ****** because his insurance declined his claim. Our company has always told our clients if you ever have an issue with your home we want to be the first call you make. I find it sad that we were only called when they want us to pay money. This matter was not a warranty claim and at this point there is no way to assess the issue.
