Entered into a real estate sales agreement on 12/10/20, to build a custom home. The transaction would be closed on or before August 31, 2021, if not complete by the contractural date, then all parties would agree in writing to a new date. In a good faith effort, to abide by obligations we provided City Hill Homes with a total $59,825.99 down towards the purchase of the premises, located at 290 *******************. On September 4, 2020, we paid $ ***** for architectural floor plans. On December 10, 2020, paid $***** in refundable security deposit. On July 20, 2021, we paid $16,153.00 in change order for Iron front and back doors. On September 30, 2021, we paid $4,697.72 in change orders for plumbing fixtures.On December 20, 2021, we paid $2,625.00 and $2,375.00 in change orders for additional can lights and zones of audio.On February 25, 2022, we paid $943.82 in change order for appliances.On March 7, 2022 we paid $ ******** in change orders for Refrigerator and Freezer which was not included in standard features. On May 27, 2022,we paid $3,710.00 in change orders. On June 1, 2022, we paid $2,009.08 in change orders for upgraded sinks. On August 23, 2022 we paid $5,360.87 in change orders for fireplace surround and counter tops. We signed an amendment, per Evolve ****s request to attempt to close. Yet home wasnt complete. Per the agreement, time was of the essence. The builders completion date was never met.The builder obtained a construction loan from the **** of ******* based on the documents we provided, by our 1st lender. Due to the builder's delays, we lost an approved loan, due to untimely financing through Veterans United. We were forced to obtain a new lender, Evolve **** and Trust, who also approved the loan. But again, time was not of essence. And we became no longer viable candidates for the approved loan as of September 6, 2022. City Hill Homes has refused to issue a refund for all monies. We did not breach. The contract was contigent on financing.Business response
